A Study on Damage and Compensate of Oil Pollution in Marine from Oil Rig / 海上鑽油平台油污染損害及賠償問題研究

碩士 / 國立臺灣海洋大學 / 海洋法律研究所 / 103 / Petroleum is a crucial element to modern society’s development. Due to the growth of the technology, oil extraction can be from on land to in the ocean. Compared to extracting crude oil on land, mining black gold in the sea has higher possibility of accidents; this results from unpredictable currents and weather. In 2010, a gas release and subsequent explosion occurred on the Deepwater Horizon drilling rig in the Gulf of Mexico. The incident caused casualties and serious oil spill. It is one of the largest marine oil spills in the United States.
After the oil spill happened, the major impact was on the environment and the economy. In addition to taking the precaution, claiming damages to the polluter is also important. This article takes the Deepwater Horizon drilling rig incident for example; besides, it leads to the understanding of current international conventions and compensation systems in America and China. Moreover, by contrasting their systems to Taiwanese institution, we can discuss the shortcomings and the improvements in our current legislation.
Thus, the article begins with the definition of marine oil pollution and then discusses how oil spill happened, changed, and damaged the environment. After knowing the event, the article mentions the importance of marine ecosystem’s recovery. The article instances the Deepwater Horizon drilling rig in the Gulf of Mexico in 2010 and indicates the possible damages from oil spill and American government’s reaction. Next, it analyzes that a drilling rig belongs to either vessel or facility; and in this way, we can identify the appliance of laws and regulations. Furthermore, it analyzes the system related to damages. This provides a reference to our country’s future petroleum extraction in the ocean.
