A Comparative Study on the South China Sea Policies between Taiwan and Mainland China / 兩岸南海政策研究之比較

碩士 / 國立臺灣海洋大學 / 海洋法律研究所 / 103 / South China Sea is important to cross-strait economic and strategic security. In recent years, with the number of offshore oil and gas facilities of Southeast Asian countries in the South China Sea increased rapidly, the two sides have suffered huge losses in the South China Sea .Strait fishermen have always been detained illegally by neighboring countries in traditional fishing waters, sometimes even paying the price in blood. What's more, the neighboring countries in the South China Sea intensify arms race in space, which has threatened seriously the cross-strait maritime strategic thoroughfare security in the South China Sea. Thus, it is very difficult to resolve the South China Sea disputes over territory and maritime zone. Both sides should take more positive attitude on adjusting their policies and change conceptions by giving up their bias to promote cooperation, for the same challenges and difficulties they faced.

This thesis first describes the history and current situation on sovereignty and sovereign rights over maritime zone, then discusses the South China Sea policies of both sides by case study on international historical water disputes, comparing with the current research of both side on historic water and U-shaped line and the revolution of policies. After this, it analyzes the possibility and extent of cooperation, and influences on policies by Sino-Philippines South China Sea arbitration. We should be aware that it is easier said than done. I hope this thesis will contribute cross-strait cooperation in the South China Sea.
