碩士 / 國立臺灣海洋大學 / 航運管理學系 / 103 / Through investigation, it is evident there are many shipwrecks caused by dangerous cargo carriage. Moreover, bulk carriers’ deadweight account for nearly half of global proportions. The importance of dangerous goods in bulk can’t be overemphasized. Once an accident happens, as liquefaction shipwrecks happened recently, it poses great risks to the owners. Further, owners may have to face the issue of ship claim, crew casualties, cargo damage and even environmental pollution responsibilities.
Clarified the characteristics of the owners when transporting dangerous goods, will take the responsibility for cargoes care and know how to prevent. In order to achieve operational security purposes, we clarified the characteristics of the owners when transporting dangerous good and discuss the responsibility for cargoes care and know how to prevent it. This article primarily analyzes the owners’ right and obligation by means of international conventions, the IMSBC Code (International Maritime Solid Bulk Cargoes Code), literature review and Charter Parties cases study. The findings are demonstrated as follows:
1. The IMSBC Code takes effect but it is not mandatory- The wording is suggetional and selective, such as “may”, “shall”, and “should”. For the classification of dangerous goods in bulk, or even the character of the risk, is roughly divided into three categories. However some bulk cargo classified two types at the same time. It should be noted that it may be a matter of negligence and dangerous as owner transporting dangerous goods.
2. When contract C/P, owner’s should write down characteristics and essential cargoes certificates. For the purpose of clearing the responsibility and risk for the respective owners and charterers. Charterers should follow up as per the latest International Maritime Organization regulations and the IMSBC Code.
