碩士 / 國立金門大學 / 海洋事務研究所 / 104 / Kinmen and Xiamen are close but separated by waters. Since the economic reform of China in 1978, economic development has been the first priority for every province. The natural environmest was thus degradated, including the soil, air, rivers and the sea.
Suffered from limited hinterland and land resources, especially coastal provinces like Fujian, China obtained land by land reclamation according to Law of the People`s Republic of China on the Administration of the Use of Sea Areas. Due to the overwhelming demand for sea sand, illegal transboundary sea sand mining by the mainland boats has been rampant on the kinmen-Xiamen waters.
In the thesis, the author tried to explore whether the maritime enforcement on the kinmen-Xiamen waters is capable for combating the illegal sea sand mining by mainland boats. The author majored on the following issues:
(一) the demand and supply policy of the sand and gravel industry;
(二) marine emvironmental deterioration;
(三) maritime safety.
The findings are as follows:
(一) by implementing the policy of importing sand from the mainland, Taiwan`s sand and gravel industry chain has been tremendously affected;
(二) illegal sea sand mining in kinmen-Xiamen waters has brought negative effects to marine environment and maritime safety;
(三) illegal sea sand mining in kinmen-Xiamen waters has brought negative effects to cross-strait relatinons and residents;
(四) Cross-strait cooperation is required for effective legal enforcement.
Upon the findings mentioned above, the author suggests:
(一) the need to maintain the professional image of the CGA;
(二) the need for a specific legislation on the enforcement;
(三) the need to strengthen the enforcement capacity;
(四) the need to regional integration competence;
(五) the need to enhance the legal enforcement.
