A Study on the Conservation and Management of Fishery Resources and Dispute Settlement between Taiwan and Japan / 臺日漁業資源養護管理與爭端解決之研究

碩士 / 國立成功大學 / 法律學系 / 104 / The Taiwan-Japan fishery conflict is a crucial issue about the international law of the sea. First, this thesis introduces the background of the fishery conflict between Taiwan and Japan, and analyzes “Taiwan-Japan Fisheries Agreement”. Second, in terms of the International Law of Fisheries, this study has found that legal system of the conservation and management of fishery resources in Taiwan leaves much to be desired. Hence, the purpose of this thesis is to do further research on the conservation and management of fishery resources in our domestic law, and propose a dispute settlement mechanism for Taiwan-Japan fishery conflict in the Taiwan-Japan overlapping exclusive economic zones(EEZs).
The research methods used in this thesis include the literature analysis method, the legal interpretation method, and the comparative research method. By the research methods, this thesis tries to provide relevant suggestions on legislative amendment of the conservation and management of fishery resources. In addition, nowadays the better strategy for Taiwan’s Fishery is to continually negotiate with Japan or other counties. Therefore, we hope that these advice and results could contribute to reduce the fishery disputes and effectively protect Taiwanese fishermen’ rights and interests. Above all, those contentious issues will indirectly impact on Taiwan’s international recognition and status, so we have to pay more attention on the development of our fishery disputes with Japan and Philippines.
