The Rockey Road of Judicial Reform-The Case Study of The Hsichih Three / 暗礁處處的台灣司法之路─從蘇建和案看台灣司法改革的變遷

碩士 / 國立成功大學 / 法律學系 / 104 / This analysis is from the evolution of The Hsichih Three and discusses the following issues: what are the main factors that affect the development of The Hsichih Three, have there been any tremendous transitions in Taiwanese judicature in the past twenty years, has the judicial innovation acquired in the 90’s by the Taiwanese society been put into practice, and what is the main reason that the development of Taiwanese judicial system was limited?

After analyzing relative news and information, it has been discovered that (1) The judicial revolution of Taiwan isn’t as successful as we thought it was. For example, the practices of Presumption of Innocence and Corroborative Rule that were commanded by 90’s Taiwan society have not been fully put into practice. (2) Secondly, the protective target of the human rights in Taiwanese judicial principle changed from the defense to the victim. This change now prevents a Lenient sentence instead of a frame-up sentence.
