碩士 / 國防大學政治作戰學院 / 政治研究所 / 104 / South China Sea holds the particularly significant influence on national defense, economy, navigation and strategy of different countries in this region, because it is an key position on controlling navigation routes bearing a third quantity of global cargo and important natural resources such as natural gas and oil.
After World War II, the Philippines, Vietnam and Malaysia had coveted the islands and reefs in South China Sea, when they became independent one after another. By 1969, the United Nations published "Emory Report", and pointed out that South China Sea islands, reefs and seabed are rich in oil and gas, thus causing neighboring countries to snatch the sovereignty of the islands of the South China Sea. In 1982, with the "United Nations Convention on the Law of the Sea," different countries began to expand their territorial seas, exclusively economic zones, and continental shelfs.
This further drives different countries in South China Sea to snatch the local reefs and divide waters, so that this region has become the focus of recent international conflicts.
CCP is the emerging regional power, which sees South China Sea as theirs regardless of the angle of history or jurisprudence. Due to its strategic needs, the desire for resources, the development of the domestic economy, and the insistence on the sovereignty, CCP shows a strong ambition on South China Sea, handling the dispute of South China Sea with a powerful posture. The situation of South China Sea becomes tense.
This paper, through an examination of the history of South China Sea and the dispute over sovereignty, tries to understand the legal basis around the major claimant nations, and sort out CCP's definition, connotation and application principles of the so- called Three Warfare. Finally, we study what actually happened in South China Sea as a result of CCP’s Three Warfare with the claimant countries in this region.
