Violation of Labor Rights in Overseas Working Holiday / 壯遊還是被「楷油」:海外打工度假勞動權益問題探討

碩士 / 國立中正大學 / 勞工關係研究所 / 105 / This study investigates the violation of labor rights in overseas working holiday, and discuss the possible methods for coping. Multiple aspects are explored, including the specific elements in which labor rights of overseas working holiday workers were violated, the results of violation and what should the workers of overseas working holiday do to cope with such violations, and the procedures in place of the government to assist the victims when violation of labor rights has occurred. A qualitative research approach is adopted through 20 in-depth interviews from individuals with personal experiences of overseas working holiday; 10 of which have worked in the United States of America and 10 of which worked in Australia. Gender is distributed evenly, with 5 males and 5 females across both USA and Australia.
This study finds that in general, overseas working holiday workers has insufficient awareness for labor rights. More often than not, due to language barriers and lack of support from consulting agencies, workers are forced to face the repercussion of violation of labor rights alone. In addition, workers interviewed also showed disappointment in the lack of aid from Taiwanese government to workers overseas, but hope it could be improved on in the near future.
This research suggests overseas working holiday programs to take into consideration the language, skills, and financial status of the applicant, and follow up on the progress after applicants return to their hometown to monitor their career advancements and determine the best course of action to improve on labor rights.
