Discussing the Legal Issues to Improve the Prevalence of Household Sewer Pipe-connection in Green River Drainage Catchment Area at Taichung City from the Local Autonomy Perspective / 以地方自治角度論臺中市綠川污水下水道接管之法律問題

碩士 / 國立中興大學 / 法律學系科技法律碩士班 / 105 / As the origin of Taichung City, Green River has been notorious for strongly unpleasant smell and highly polluted water body, especially the middle course that runs through the downtown area. Rapid urbanization and massive population releasing household wastewater directly into the river made it one of the most contaminated area in whole city. The wastewater left on ground also causes the spread of infectious diseases. All these negative impacts to Taichung residents can only be solved by residential waste pipe connected. With proper equipment in city establishments, this system will take all residential wastewater to public wastewater sewer and treatment plant. Wastewater will be treated and ensured it''s in acceptable condition before again released to river and ocean. However, the connection rate in Taichung city is low. According to Centre for Pattern Analysis & Machine Intelligence, only 13.19% of the residential property is connected in 2015, only 1.1% than previous year.
This author will discuss this environmental problem in Taichung city from the local autonomy, resident autonomy, and group autonomy perspective. By utilising literature analysis and in-depth interview, it is noticed that Taichung residents not motivated to connect to wastewater sewerage with current institution and practice because Taichung municipal government will not legal action to impose the installation in intention to avoid public complaint. On the other hand, even with the free instillation, current incentive is not enough to attract residents to do so.
Appointing to solve listed problems, this author concludes three stages of this issue: 1. As the main instrument of promotion, current rewarding incentive is not attracting enough. 2. The land use right of back alley, where most of sewerage system located. 3. The lack of knowledge regarding sewerage and it''s importance among Taichung residents. This author’s suggestions to Taichung municipal government includes: 1. As practiced in Taipei city, increase the incentive so the residents are more willing to join the free installation. 2. Use majority ruling to meditate the conflict between public interests and private property rights. 3. By strengthening due process of law, protects and increases resident participation efficiency. This author also suggest that after the new residential pipe connection system, it is reasonable resource allocation to apply firstly to Green River drainage catchment area and has its necessity.
