碩士 / 國立臺灣海洋大學 / 海洋事務與資源管理研究所 / 105 / After the Guang Da Xing No. 28 incident, Taiwan and the Philippines signed the Agreement on Cooperation in Enforcement of Fisheries Law (i.e., The Agreement Concerning the Facilitation of Cooperation on Law Enforcement in Fisheries Matters) on November 5, 2015. However, when fishing vessels of Taiwan caught fish in overlapping exclusive economic zones, they are still afraid of encountering the Philippines governmental vessels. The provisions of Fisheries Agreement between Taiwan and Philippines are focused on avoiding the use of violence or unnecessary force, establishment of an emergency notification system and establishment of a prompt release mechanism. However, regarding the scope of fishing operations and fisheries jurisdiction, which may provide the clearest and direct protection for Taiwan fishermen, was not included. In this regard, this study explores the respective legislation and propositions of the waters of Taiwan and Philippine by literature review, and finds out the core issues of the conflict bwtween Taiwan and the Philippines. It also conducts a comparatrive study on Taiwan-Philippines Fishery Agreement and that in other countries. Using the integration of comparative analysis and practical comparison, this thesis concludes the fesible recommendations for the amendments of the mentioned Fishery Agreement. They are: (1) For the short terms -- strengthening the management and enforcement in the sensitive sea areas; (2) For the medium term -- continuously negotiating disputes and timely amending relevant provisions of the Fisheries Agreement: (3) For the long terms -- establishing the stable and peaceful fishing grounds to achieve the goal of mutual benefits and the sustainable utilization of fishery resources.
