A Study on the Management of Recreational Fisheries and Coast Guard Administration Enforcing Safety Inspections in Yunlin / 娛樂漁業管理與海岸巡防機關執法之研究-以雲林地區為例

碩士 / 環球科技大學 / 公共事務管理研究所 / 105 / The purpose of the recreational fisheries is to provide the fishing boats for the local residents doing leisure activities on the sea in order to enhance the people’s health and leisure, and mental health, i.e., to make residents involve with fishing and farming operation, or doing the leisure activities by using the fishing facilities, or experiencing and the lifestyle of fishing villages and enjoying the culture of it. The original management of recreational fisheries belongs to fisheries authority, however, considering with its human resource and executing ability, announce commission of the coast guard administration to execute the outbound inspection of recreational fisheries and stop departure immediately and some issues regarding to management of partial violation regulation. Due to the unclear of mandatory jurisdiction to the violation, the diverse opinions of the regulation from the fishery authority and coast guard administration, it has caused a number of difficulties of implementing the management for the coast guard administration.
 The study focuses on investigating the current situation of recreational fisheries operation in Yunlin district to figure out the coast guard officers’ difficulty of executing the policy by analysing the regulation and doing the qualitative survey of local recreational fisheries workers, officers in coast guard administration and tourists (anglers). It has been found from the study that the recreational fisheries in Yunlin district are all running concurrently on recreational fishery boats, and Yunlin County Government (YCG) has formulated the local autonomy regulations to manage it by following《Regulations for Recreational Fishery》. However, the local autonomy regulations did not be modified by the mother law, so it has not corresponded the current situation. For example, batching the passengers and floating roof fishing and some behaviours are unregulated. Moreover, the opinion about stopping violated boats immediately of the YCG and officers of coast guard administration is different, and it has caused an obstacle of delivering the cases and the case management. It can be suggested that to modify the current related regulations in order to manage the recreational fishery comprehensively and to maintain the residents’ safety on sea activities. Also, it can be found that there are some recreational fisheries have no legal facilities in this area, therefore checking the boats randomly to enhance the recreational fishery management is required.
