The United Nations Commission on International Trade Law (UNCITRAL) took into consideration the development of the status of e-commerce and maritime affairs. On December 11th, 2008, the United Nations passed the “Convention on the International Carriage of Goods under the United Nations for the Entire or Part of the Sea”. (United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea) and decided to hold a signing ceremony in Rotterdam, the Netherlands, on September 23, 2009, which was open for signature by member states. The Convention was therefore named Rotterdam Rules. The Rotterdam Rules is an international convention for the carriage of goods by sea following the Hague Rules, Hague Visby and Hamburg Rules. The goal is to unify the international legal regime for the carriage of goods by sea, which involves the multimodal transportation including maritime transport. Define the liability of carrier,the obligations of shipper, and introduce new content such as electronic transport records, volume contracts, and the rights of the controlling party.
After the entry into force of the Rotterdam Rules, there will be some impacts and effective on the global shipping sector. There are major changes in the rights and obligations of shippers, shippers, and consignees on sea shipping. The rights and obligations of the shippers on land, port-related parties, and banks and insurance industries in the international trade industry and surrounding industries are also important. Have a significant impact. Taiwan is narrow hinterland and its economic depends mainly on the development of international trade. The development of international trade has a close relationship with maritime transport. It is an important issue for research that the impact of Taiwan’s maritime transport and international trade development on the Rotterdam rule after the entry into force of the Rotterdam Rules.
The main features of this study is the provisions of Taiwan’s maritime law and the Rotterdam Rules concerning the liability of the carrier of goods on the sea, and it will be studied, analyzed, compared, and provided with reference to Taiwan’s maritime law.
