Due to the traffic and economic functions, the value of ocean covers from humanities to polictics, and keep influencing the ocean affairs of our country. Moreover, after the United Nations Convention on the Law of the Sea (UNCLOS) has put into practice, the systems of ocean law began to change it’s core, from private law to force a law, and starting to work for ocean sustainable development.
After years’ of negotiation, ‘Ocean Affairs Committee’ has already established in April 2018. Meanwhile, the authority of ‘Ocean Affairs Committee’ still untrue. Even though the ocean administrative branch of government has exist, the fact is we’re lacking in ocean administrative integrating and manageable organization system. And according to administrative level or organization law, ‘Ocean Affairs Committee’ will nothing new to show.
To summarize the administrative theory, authority and organization of Taiwan’s ocean administrative, this research reviewed the reports of predecessors, and raises the “Marine Affair Office” to set up an integrating ocean administrative organization system.
Therefore, ocean administrative needs the ocean policies and takes them effect. “Marine Affair Office” belongs to Executive Yuan and set up the highest administrative level, the simplest funds and the most powerful in our country, which will help for integrating and managing the power of ocean administrative.
Thus, this research is an administrative paper, so we choose the research method call “Five Major Frameworks of Administrative Law”. As a result, we’ll explain the “Marine Affair Office” about theory, organization, authority, relief and supervision. Finally, to pursue a well ocean administrative system for the country and national’s future.
