碩士 / 國立臺灣海洋大學 / 航運管理學系 / 106 / According to the principle of the International Convention for the Control of Ballast Water and Sediment of Ships, this thesis analyzes the current situation of make the International Ballast Water Convention and the current situation on the implementation of the International Ballast Water Convention. In the way of interviews with relevant professionals,this thesis tries to understand their opinions and ideas on the implementation of ballast water regulations in Taiwan,collect foreign and domestic related information,and summarizes the ballast water management methods and countermeasures applicable to Taiwan,in order to provided reference the implementation the ballast Convention in Taiwan.
The thesis found that there is no applicable law on the control of ballast water in Taiwan, except that provided by Article 75 of the Commercial Port Act. The current law of Taiwan does not offer sufficient basis for the management of ballast water， and there is also lack those provisions relating to the penalty of violation.It suggests that in addition to cope with international regulations, if it is more in line with the real needs of Ballast Water Management, it can be assessed in the real situation in Taiwan and the existing laws and regulations will be modified to meet the real needs.
