A Study on the Labor Conditions of Cabin Crews-Focusing on the Working Time / 客艙組員勞動條件之研究-以工作時間為中心

碩士 / 世新大學 / 法律學研究所(含碩專班) / 106 / The Labor Standards Act is a basic law that protects labor rights. To cope with some labor hard to apply the statutory working hours benchmark conditions in certain industries. Therefore, Article 84-1 of the Labor Standards Act was made on December 27 1996 to give the management flexible use of labor hours, to avoid business problems. In order to increase profit and aircraft utilization rate, it is inevitable for the management to make efforts to negotiate new air routes, shorten the time for ground operations, and expand the flight time band. This is resulted in increase in the number of red-eye flights. The calculation method for cabin crews is limited by the provisions of Article 84-1 of the Labor Standards Act, which compressed the rest time. The lack of rest time affects not only the cabin crews but also the flight safety.
With the rise of labor awareness, the government’s emphasis on labor policies, and the international trend of caring for labor, the labor relations have even led to strikes in the country that union-led cabin crews to fight for their rights on the streets for the first time. Labor and capital are located on the two sides of balance, which are fighting for labor rights and pursuing the best interests. The trade unions and the government have an important position on the balance, and how to do it would not because of over-biasing a party coused imbalances. It also requires intelligent decision.
The scope of this study will use cabin crews as example to discuss the protection of cabin crews labor rights, conduct research on current practice cabin crews' work patterns and working hours, and try to understand the "specialty" of the work from the management's perception, and the “necessity” of flexible use of labor hours exists at the time, explores how the management and labor can balance work hours and rest periods under the system of reasonable liability, and build a work-hours protection system that meets the need of professional specialities and fairness in order to maintain the labor rights of cabin crews and the safety of passengers.
