博士 / 東海大學 / 社會工作學系 / 106 / In the twenty-first century, marriages in mainland China have been evolving for a period of time. Owing to divorce rate increasing, family disputes have grown in need with pattern diversities and solution difficulties. Mediation is the most effective mechanism to resolve family disputes except litigations. On the one hand, Chinese culture has cultivated the notion of “harmony” of Chinese, which paves the way for the development of family mediation system. On the other hand, after the year of 2016, the procedure of family mediation of the Supreme People’s Court of the People’s Republic of China and working mechanism evolution have created potentials for professional development, which provides a new direction for social work.
This research explored the constructing professional knowledge of social workers for family mediation in Shanghai. Taking Putuo People’s Court in Shanghai as the research field of family mediation, this research adopted co-operative inquiry to solve problems and improve current situations. Through the cooperation of research facilitator, co-researchers and an external research assistant, they made out a plan to change the current situation, took actions and further reflected improvements in the social work intervention of family mediation. This research constructed the professional knowledge of social workers for family mediation in the following five aspects: 1) deepen tendency of mutual cooperation; 2) formulate procedures of mediation; 3) extend scopes of mediation; 4) establish data collection and assessment framework of marital conflicts, child support, and property division; 5) develop skills of reconciliation. Finally, this research emphasizes that Chinese family mediation needs to renew notions, restore functions, postulate laws, connect procedures, excel social workers training, regulate job duties, and enhance skills.
