Since our country is surrounded by sea, the volume of import and export containers is quite large. Therefore, border management becomes a key part of our border security. And border security check is the key control mechanism for overall border management. To control and maintain borders can be both open and secure, the authority has to strengthen the co-operation of border-related agencies, especially customs administration and border police.
The authorities responsible for the inspection of maritime import containers are the Customs Administration, Ministry of Finance and the Third Special Police Corps, National Police Agency, Ministry of the Interior. The Customs Administration is the authority in charge of the process of importing and exporting containers’ clearance and seize evasive tariffs or smuggling control goods. And the duty of the Third Special Police Corps is maintaining border security, investigating unlawful smuggling and examine seaborne import containers. This study also compare the container security inspection mechanism between R.O.C and the United States, and take the U.S container inspection mechanism as reference.
The subject of this study is border security inspection mechanism, centering on the law of police inspection on maritime import container. This study aims to discuss the Third Special Police Corps’ organization, inspection enforcement, remedy law and problems encountered during inspection, then discuss the solution and suggestions of the law amendment and policy-making.
