Use of Weapon by Coast Guard / 論海岸巡防機關之器械使用

碩士 / 中央警察大學 / 水上警察研究所 / 107 / To intergrate planning, coordination and implementation of marine-related policy, as well as to conduct affairs related to waters and coast guarding, marine conservation and marine research, the Executive Yuan establishes the Ocean Affairs of Council. Ocean Affairs of Council maintain the order of the Waters and the Coast, conservation and making good use of resources, ensuring national security and protecting people’s rights and interests in Taiwan area, strive to implement "maritime law and order", "fishery protction","maritime affairs","maritime search and rescue"and "maritime conservation"five core missions. In order to maritime safety, Coast Guard is legal use of weapon according to Coast Guard Law Article13, as well as is perform their duties as provided in Article 4, the Coast Guard shall be equipped with warships, aircrafts, vehicles, weapons, ammunition, high-tech monitoring systems and any other requisite instruments whose specifications and functions enable the Coast Guard to carry out their tasks. As mentioned above equipments afforded for the coast guard diversify selection when confronted suspected vessel and its crew in maritime law enforement, but it must be carefully. Otherwise, less hurts the innocent people, more leads to cause of war. Thus, this thesis divided into 5 chapters, Chapter 1 describes the research motivation, research purpose, and research methodology and scope of this paper. Chapter 2 is weapons definition, subject and objet. Chapter 3 describes the use of weapons in international law about the coast guard. Chapter 4 describes the use of weapons in domestic law about the coast guard. Chapter 5 is conclusion that how to use of weapons in my opinion.
