A Study on the Law Enforcement Energy of Kinmen Coast Patrol from the Trespassed Fishing of Mainland China Boats in the Sea Area of Kinmen / 從大陸漁船越界金門海域捕魚論金門海巡執法能量之研究

碩士 / 國立金門大學 / 海洋與邊境管理學系碩士班 / 107 / The main purpose of this study is to explore the energy, dilemma and coping strategies of the Kinmen Coast Guard in enforcing the ban on cross-border fishing by mainland vessels in the Kinmen sea area. Through literature review and interviews with relevant law enforcement officers of the Kinmen Coast Guard, this study presents the following findings and recommendations.
1. The current law enforcement energy dilemma faced by the Kinmen Coast Guard.
(1) Mainland cross-border fishing vessels used to be mostly small ones, but now they are mostly large ones. They are iron-hulled vessels and are not easy to be found. We rely heavily on boarding inspection, which easily causes damage to vessels and people.
(2) There are many reefs along the coast of Kinmen so that it is not easy to find the mainland cross-border fishing vessels.
(3) Inadequate training of personnel, inadequate and obsolete duty-performing equipment, and inadequate appropriateness will not only pose risks to law enforcement personnel, but also affect the effectiveness of enforcement, resulting in poor impression of the law enforcement by the coast guard on the people.
(4) The lack of political exchanges between the two sides of the Taiwan Strait and the lack of cooperation mechanism in coast guard law enforcement have had a negative impact on the effectiveness of law enforcement and increased the risk of our law enforcement personnel on duty.
2. Coping strategies of the Kinmen Coast Guard on the current law enforcement energy dilemma.
(1) Cooperate with coast patrol boats on joint duty.
(2) Request the Kinmen Coast Guard to coordinate with the mainland on the law enforcement actions from time to time.
(3) Request the Central competent authorities to cooperate with the mainland authorities to jointly combatthe mainland cross-border fishing vessels.
(4) Actively ask the government of Kinmen County to grant berths for anchor and detaining of the mainland vessels.
(5) Apply to the Central Government for appropriating more budgets on duty-performing equipment and personnel.
