碩士 / 開南大學 / 人文社會學院法律碩士在職專班 / 107 / In order to cope with the increasingly complex sea area crimes, the government set up a special agency for coastal patrols (referred to as the Sea Guardian). In the face of continuous renovation of criminal techniques and the addition of the Shanghai area, coastal crime investigations are often related to inland areas. Smuggling and smuggling cases have also been heard in inland investigations.
The current Coastal Patrol Law 4 matters, the 8th exercise outside the jurisdiction and the 10th judicial police identity give the sea patrol officers the basis for law enforcement. Because the provisions of the law are not clear enough, the sea patrol personnel are facing the extension of the sea and coastal crimes. In the case of inland, the dispute is whether the inland still has jurisdiction, and whether the criminal procedure is a question of judicial police status.
In order to strengthen the investigation and smuggling, smuggling the law enforcement energy, and avoiding the disputes of the sea patrol personnel inland investigation, it is considered that the provisions of the current coastal patrol law are too simple or even clear enough. In the face of the current inland law enforcement disputes, it is recommended that the law can be amended and the sea patrol can be updated. The staff authority exercise law and related sub-laws can fill the gaps in the current regulations.
