A study of Taiwan''s and China''s Salvage Systems Based on the International Convention on Salvage / 從海難救助國際公約探討兩岸海難救助制度

碩士 / 國立中山大學 / 中國與亞太區域研究所 / 107 / Since ancient times, the Taiwan Strait has been an important maritime transportation hub and a region rich in marine resources. It plays an important role in cross-strait trade, the business between East Asia, and the fishing operations of fishery resources. Moreover, due to the passage of the black tide, the north-flowing ocean current, brings the biodiversity of the sea area, has caused endless ship incidents. So, the emergency shipwreck rescue is a necessary administrative means.
  Recalling numerous cases of ship strandings, ship collisions or shipwrecks in the strait between 2005 and 2019, those incidents have caused serious loss of property, casualties, and the pollution of the surrounding marine ecological environment. Furthermore, the emergence of political estrangement has highlighted the executive obstacles of the cross-strait shipwreck rescue. It exposes the idleness of administrative action and shows that the pipeline of cross-strait communication cannot be clearly established.There is no clear division and treatment standard for the accountability and jurisdiction after the outcome of the cross-strait shipwreck, and even for administrative relief and damages.
  Therefore, this paper applies the provisions of the International Convention on Salvage to run historical research, literature analysis, and comparative analysis for a clear structure analysis of builting a more suitable shipwreck rescue mechanism. Viewing the previous cases of maritime disaster relief treatment, the abovementioned research methods improve the establishment of cross-strait maritime disaster rescue. It drives a future hope of maximizing mutual benefit of the rescue of the two sides of the sea.
