Taiwan government in order to maintain national security, economical ordinary and public interest, make variety trade policies and control measures to make a specification for economic activity. Because of Taiwan have long coastal line in geographically, Taiwan law enforcement is struggle to combating illicitness. Otherwise, law sanction and illicit interest are asymmetric, and people have lack of consciousness of rule of law, smuggling was rampant.
Smuggling is kind of economy crime, it effect national tax revenue and disturb economy ordinary. What if smuggled item was drugs, guns, human, animals or plants, certainly those were became a threat and leak for social security and diseases prevent. In obviously, the hazardous of smuggling has quite critical criminal behaviours. The items of smuggling activity of crime module will change with political environments, economy status, market demanding and investigate measures. Smuggling period has been changing that the type of smuggle changed from personal to organisational.
In this essay evaluated that the items be smuggled by Taiwan fishing vessel came from mainland china and south east countries. There are some factors will effect smuggling which are economy, politic, social, law and geographic. According to, in recently years, smuggling ring has been becoming organized, multi- hierarchies, international and division. Its structure has accuracy and, division of labour based on specialization. Due to idea of human right has rising, strictly implement fishing vessel checking, brought about on human right invasion and effect free activity freedom of people, and investigational obstacle. Smuggling can required amazing illicit interest. Compare imports and exports within fishery port and commercial port, fishery port has not more rigorous. According to Taiwan national acts which are lack of effect for punishment, otherwise investigating agency has insufficient on manpower, budget, and equipment. The critical problems that lead fishing vessel keep smuggling and that are abundance of maritime resources and weak awareness of illegality.
The problems as mentions above, strengthen capability of border law enforcement, and improve measures of fishing vessel and crew management, increase budget of law enforcement agency, revise acts to intimidation and prohibit illicit activity, strengthen verification production licence for fishery and cigarette. Upgrading and transformation for fishery industry, propose strategy and suggestion for prevention illicit smuggle.
In this essay, dedicate on prevention Taiwan fishing vessel to engage in smuggling. And examining government policies from past to present, discussing obstacle issue of implementation performance, with the purpose of through this paper effort that evaluating suggestion for prevention strategy.
This paper adopted by various approaches, like as literature review, data analysis, case study and qualitative interview. Consistent with past decade of investigation cases and official statistic from Coast Guard Administration, Ocean Affairs Council, that is base resource to this study. Furthermore, analysis facts of smuggling and fundamental theory, research crime module and current situation, gather data from court’s judgment and news bulletin, in order to consideration struggle in investigation field and prevention policy of government of inadequate.
