碩士 / 國立臺灣海洋大學 / 環境生物與漁業科學學系 / 107 / The aim of this study is use document analysis to explore the regional sovereignty issue of the South China Sea. Using comparative analysis to look throw the fishery status of the world, South East Asia and the countries around South China Sea in these years. Hope to provide useful suggestions to solve fishery disputes in the South China Sea. Maintain peace and stability in the area. The results of the study are summarized as follows:
1. The fishery disputes are mainly caused by two major factors in the South China Sea. The first reason is sea area and island sovereignty. The other one is the national fishery problem around the South China Sea.
2 . In the sovereignty problem. None of the countries have had legal sovereignty of the islands in the South China Sea, after World War 2. Then the UNCLOS expands the scope and rights of coastal and island nations to control the surrounding water. The countries around South China Sea are vying to occupy the islands. It made the atmosphere tenses around here.
3. In recent years, the countries around the South China Sea have achieved political more stability. It made economic and population growth. So they need a large amount of food for the people. Resident near the coastal have invested in offshore fisheries. In the absence of fishery experience and equipment in developing fishery countries. IUU fisheries behavior disturbs the fishery order. And small-scale fisheries result in the loss of catch.
4 . Under the influence of both matters. Fishery disputes often occur between fishermen around the South China Sea. Fisheries disputes are prone to expanding to territorial disputes between countries. The two issues have to be resolved at the same time.
5 . Shelve sovereignty disputes and emulate the model of the East China Sea. It is a good way to solve the problem. Sign fishery agreements between neighboring countries, and planning the right to work in various working water. The law enforcement vessels of various countries jointly manage and maintain the fishery order in the South China Sea.
6 . Use fishery resources effectively can also reduce the method of fishery competition in the South China Sea. Countries to strengthen regional fisheries management can give fish organisms sufficient breeding time to restore original resources. Improve the equipment of small-scale fisheries and reduce the losses caused by fishing, processing and transportation, so as to make good use of limited catches.
