Gustavo Miranda Espinoza [Parte II] / Este trabajo busca determinar la existencia o no, de algún menoscabo al
derecho a defensa de los contribuyentes en los procesos contenciosos tributarios
contenidos en el Código Tributario, producto de la aplicación del inciso 11° del
artículo 132 del Código señalado. Para estos efectos, en primer término, se estudiará
la institución de la inadmisibilidad probatoria tributaria, iniciando con su marco teórico.
Posteriormente, se examinará de manera lógica y sistemática la normativa vigente y
aplicable en materia tributaria, enfrentada a la jurisprudencia emanada de los
Tribunales Tributarios y Aduaneros, para así, finalmente, establecer la existencia o no
de la vulneración del derecho referido, y con ello, las normas del debido proceso. / This work searches to determine the existence or not, of any detriment to the
taxpayer´s right of defense in tax contentious proceedings content in the Tax Code, as
a consequence of the application of article 132, subsection 11, of the aforementioned
Code. For these purposes, in first place, it will be studied the tax evidentiary
inadmissibility institution, beginning with its theoretical workframe. Afterwards, it will be
examined in a logical and systematic way the applicable tax regulations in force,
confronted to the jurisprudence issued by the Tax and Custom Courts, in order to,
finally, establish the existence or not of an infringement of the referred right, and with
that, the due process rules.
