Orientador: Yvete Flávio da Costa / Banca: Nelson Nery Júnior / Banca: Georges Abboud / Resumo: O escopo desta dissertação é demonstrar a relação existente entre a igualdade e a tutela coletiva, visando comprovar a salutar integração entre os mecanismos processuais existentes para a defesa de direitos coletivos em sentido amplo e a defesa dos direitos fundamentais. A temática é multidisciplinar e envolve alguns campos da ciência jurídica, como teoria do estado e direito constitucional, além dos dispositivos legais que disciplinam a processualística coletiva nacional. Busca-se a integração entre a formação das sociedades e a estruturação do denominado Estado Democrático de Direito com os instrumentos que permitem ao jurisdicionado lutar por direitos fundamentais efetivos e por políticas públicas eficazes. A igualdade, neste trabalho, é conceituada como paradigma, pois compõem a estrutura que integra paradoxos, frutos das relações e conflitos entre as normas existentes para defesa de direitos fundamentais. Não se ignoram, entretanto, os clássicos debates sobre igualdade como regra ou princípio, apenas não se considera esta a melhor saída para os problemas da sociedade moderna, fruto de um processo histórico cujos resíduos encontram-se em uma sociedade individualista, globalizada e desigual. Temas tangentes compõem a temática proposta, como a comparação entre a igualdade e a Justiça, a conceituação e compreensão da democracia e a análise de alguns casos colhidos nas cortes superiores para ilustrar a integração entre a norma (seja de tutela coletiva ou norma constitucional que embasa direito fundamental) e a realidade. Desse modo, é possível inserir a pesquisa em um patamar de relevância para a ciência jurídica, não por ser única ou por imaginar ser ela uma referência, mas por se preocupar em apresentar a igualdade com um novo viés, estimulando os debates. Para a estruturação da pesquisa, buscou-se a utilização da metodologia jurídica... / Abstract: The scope of this dissertation is demonstrating the relation between equality and collective protection, aiming to prove the salutary integration of procedural mechanisms to defend collective rights, in a wide approach, and the fundamental rights. The theme is multidisciplinary, and involves some fields of juridical science, like State theory and Constitutional Law, and also the legal instruments that discipline the national collective judicial procedure. It's intended to seek integration between the creation of societies and the structure of the so called Democratic State of Law with the instruments that allow the ones under jurisdiction to fight for effective fundamental rights and public policies. Equality, in this research, is conceptualized as a paradigm, once it makes part of a structure that integrates paradoxes, resulting of relations and conflicts between existing norms to protect fundamental rights. However, the traditional debates about equality as a rule or principle aren't ignored; in fact, they aren't considered the best solution to the issues of modern society, result of a historical process with residuals located in an unequal, globalized and individualist society. Matching subjects compose the theme intended in the research, such as the comparison between equality and Justice, the conceptualization and comprehension of democracy, and the analysis of some cases taken from superior courts to illustrate integration between the norm (either collective protection or Constitutional norm supporting fundamental rights) and reality. This way, it's possible to insert the research in a relevant level for juridical science, not for being unique or a reference, but for worrying about presenting equality under a new perspective, inciting debates.
