Orientador: Carlos Eduardo de Abreu Boucault / Banca: Daniel Damasio Borges / Banca: Victor Gabriel de Oliveira Rodriguez / Resumo: A pesquisa tem por objetivo examinar a problemática e a questão dos apátridas, partindo da afirmação da nacionalidade como bem jurídico fundamental e universal a todos os indivíduos ao redor do mundo, abordando os casos incidentes de sua perda e os reflexos sobre as grandes dificuldades em se proteger tais indivíduos. Visa analisar, sob um panorama e um contexto jurídico-social, além de sob a óptica dos Direitos Humanos e dos princípios fundamentais ao homem, as soluções e medidas propostas pelos vários institutos do Direito Internacional já existentes em relação à situação dessas pessoas, visando afirmar e resguardar jurídica, social, política e diplomaticamente o direito a uma identidade, a uma cidadania e a uma nacionalidade reconhecida perante todos os Estados, colocando em xeque e flexibilizando preceitos e ideais até então absolutos, como a soberania dos Estados. Assim, aborda a situação, os institutos, as particularidades, os tipos e demais matérias envolvendo a definição e contextualização da apatridia ao redor do mundo, afirmando a necessidade de renovação e reestruturação dos mais variados institutos, ferramentas, instrumentos e pensamentos jurídicos, como por exemplo a própria noção de cidadania e nacionalidade, que incidem sob questões sociais e culturais, como a dos apátridas. Expõe daí, sob a ótica nacional e internacional, a evolução e formação de um novo pensamento e ideal jurídico internacional a partir da revisão, ampliação, relativização e flexibilização, a partir da construção histórica do saber jurídico, de muitos institutos, preceitos, bens e valores do Direito em si, sobretudo do Direito Internacional, em prol da melhoria da situação dos apátridas; do fim prático dos limbos legais de ausência de nacionalidade e cidadania; da maior humanização no tratamento, respeito, tolerância e acolhimento ao ser humano, principalmente o estrangeiro; e da efetividade... / Abstract: The research aims to examine the issue of the stateless persons; it based on the affirmation of nationality as a fundamental and a universal legal right to all individuals around the world, addressing the incident cases of nationality loss and the reflections of the great difficulties in protecting such individuals. Aims to analyze, in a social and legal context, as well as from the perspective of the Human Rights and the fundamental principles of men, the solutions and measures proposed by the various international law institutes in order to assert and safeguard by the legal way, by the social way, by the political way and by the diplomacy way, the right to a identity, a citizenship and a recognized before all states, easing precepts and ideals hitherto absolute, as the sovereignty of national States. It addresses the situation, the institutes, the features, the types and other matters involving the definition and the context of statelessness around the world, furthermore it affirms the need to renewal and to restructure of various institutes, tools, instruments and legal thoughts, such as example the notion of citizenship and nationality, which focus on social and cultural issues, such as stateless persons. It exposes under the national and the international perspective, the evolution and the formation of a new international legal thought from the revision, the expansion, the relativity and the flexibility, of the historical construction of legal knowledge, of the many institutes and precepts, of the international law goods and values, in order to improve the situation of stateless persons. It aims to flexible and to improve the end of the legal limbo of nationality and citizenship absences. It also approaches a better humanization of treatment, of respect, of tolerance and of acceptance to humans, especially foreign people.
