Neste sentido, iniciando pela trajetória histórica dos direitos humanos e das mulheres, qualificando a categoria gênero no campo da produção do conhecimento das Ciências Humanas com relação ao direito humano à educação. Em seguida, ao refletir sobre o processo de encarceramento feminino, aproveito para discutir fundamentos do punitivismo na conjuntura atual numa perspectiva crítica e feminista, contando com pressupostos críticos ao Direito Penal. Quanto à linha metodológica, adotando uma abordagem qualitativa, a pesquisa empreendeu estudo de campo junto a uma unidade penitenciária feminina do interior paulista, tendo produzido dados por meio de registros de entrevistas com dez mulheres em situação de privação de liberdade, cujas contribuições por sua vez foram examinadas utilizando-se da análise de conteúdo que resultaram em indicadores e categorias que foram reunidas num campo de quatro núcleos de sentido, sendo estes, direito, educação, gênero e punição, cuja interpretação considerou contradições face ao direito humano à educação no sistema penitenciário. / Abstract: The present study analyzes the education directed to women in situations of deprivation of liberty, choosing education and gender in the penitentiary system as a problem. In this sense, starting with the historical trajectory of human and women's rights, qualifying the category of gender in the field of knowledge production of the Human Sciences with respect to the human right to education. Then, in reflecting on the process of female imprisonment, I would like to discuss the foundations of punitivism in the current conjuncture in a critical and feminist perspective, relying on critical assumptions to the Criminal Law. As for the methodological line, adopting a qualitative approach, the study undertook a field study with a female prison unit in the interior of São Paulo, producing data through interviews with ten women in situations of deprivation of liberty, whose contributions in turn were examined using content analysis that resulted in indicators and categories that were gathered in a field of four sense nuclei, these being, right, education, gender and punishment, whose interpretation considered contradictions with the human right to education in the penitentiary system . / Doutor
