Buscou-se analisar as medidas adotadas pelas diferentes legislações, que vigoraram no Brasil no período investigado a partir de um estudo nas Varas Criminais de Assis-SP, nos boletins de ocorrência na Delegacia Especializada e no Comando da Polícia Militar da circunscrição local. O eixo da pesquisa é o aumento de criminalidade e a banalização do crime e da pena na realidade local. Em guisa de hipótese, acredita-se que a tendência do fortalecimento das práticas repressivas tem contribuído para a superlotação carcerária e a baixa eficácia. O estudo de caso indica que a atua pratica do Estado tem levado o sistema penal a uma crise de legitimidade e à banalização do conceito de crime/punição. Como fundamentação teórica, o presente trabalho apoia-se nas contribuições do sociólogo alemão Norbert Elias (1897-1990), da filósofa política Hannah Arendt (1906-1975) e do jornalista Roberto Saviano (1979), entre outros autores da História, do Direito e áreas afins / Abstract: This research aims to investigate the anti-drug policy used in Brazil from 1960 to 2010, based on a case study in Assis-SP. We sought to examine the measures adopted by different laws, which have been in Brazil in the period investigated from a study in the criminal courts of Assis (SP), in newsletters of Local Police Department Specializing and in command of the Military Police of the division site. The axis of the research is the increase of crime and the trivialization of crime and punishment in the local reality. By way of hypothesis, it is believed that the tendency of strengthening of repressive practices have contributed to the prison overcrowding and the low efficacy. The case study indicates that the acts practiced in the state has led the criminal justice system to a crisis of legitimacy and the trivialization of the concept of crime/punishment. As a theoretical foundation, the present study is based on the contributions of the German sociologist Norbert Elias (1897-1990), the philosopher politics Hannah Arendt (1906-1975) and of the journalist Roberto Saviano (1979), among other authors of History, Law and related fields / Doutor
