Présent dans les institutions d’un nombre croissant d’États ayant le plus souvent connu de graves crises, le partage du pouvoir n’était pas jusqu’ici un objet d’étude pour la recherche juridique francophone. Ce n’est pas un concept juridique identifié, mais il implique différents mécanismes juridiques et comporte des traits communs avec certains autres. Une certaine doctrine politiste a voulu en faire un mode de gestion courant des sociétés, mais c’est surtout un outil de gestion de crise, utilisable dans la prévention des conflits comme dans la consolidation de la paix. Sans modèle fixe, et sans qu’aucun format adopté ne soit immuable, c’est un outil adaptable, dont on peut se demander s’il n’a pas vocation à être temporaire. Mais son usage, pour pacificateur qu’il soit le plus souvent, n’est pas sans impact sur les sujets du droit international et particulièrement sur le statut de l’État / Although present in the institutions of many States that suffered from terrible crises, power-sharing wasn’t studied by the French legal doctrine. Power-sharing is not a legally identifiable concept, but it implies different legal mechanisms and shows some similarities with some others. A certain political doctrine wanted to use power-sharing as a frequently used model for societies’ organization, but it is, first and foremost, a tool of crisis management which can be used in conflict prevention as well as in peace consolidation. Without a fixed model and without an intangible set of characteristics, power-sharing is an adaptable tool, but it may be a temporary one. Its’ use, although frequently peaceful, is not without an impact upon the subjects of international law, and namely upon the State itself
