Výpověď z pracovního poměru / Notice of employmentHomolková, Simona January 2011 (has links)
The Notice of Employment The main reason I have chosen this topic for my diploma thesis is that we have to deal with questions of labour law in our everyday lives. Generally speaking it is a common issue and I believe that it is therefore very important to understand it correctly. The notice of employment can bring serious economic and social consequences into the life of every employee and at the same time have an impact on his family members. On the other hand the employers should be able to terminate employment with such employees who are irresponsible or incompetent. Hence, the aim of this thesis is to analyse the regulation of the notice of termination of employment in the legal order of the Czech Republic, explain the essential principles of this regulation and point out various options of its interpretation. The paper is divided into seven chapters. First, there is a general outline of the examinated issue followed by chapters dealing with the historical evolution of legal regulation and the European Communities` regulation of the notice of employment. Further passages are in regards to a closer analysis of the notice of employment in general, notice given by the employee, notice given by the employer and their legal reasons. Relevant judicial decisions were also incorporated in each of...

Agenturní zaměstnávání / Agency employmentTomčíková, Ilona January 2011 (has links)
- Agency Employment For my thesis topic, I have chosen "Agency Employment". It's a relatively young institute, which was incorporated into our legal system only on October 1st, 2004. I believe that Agency Employment topic can be always considered current and positive, because it allows us to flexibly react to the needs of the job market. Since the topic is very broad, the goal of this paper is not a detailed analysis of all aspects of this institute, but only a few of them that I consider to be most important. I shall present and evaluate current law governing the subject and also try to point out its flaws. I have structured the thesis into 4 chapters, further divided into subchapters. The conclusion contains summary and de lege ferenda reflections. At the beginning it is appropriate to introduce the topic, therefore the first chapter is dedicated to the Agency Employment concept and other connected topics. That includes employment mediation, license for employment mediation and dependent work. In the second chapter I examine the progress of Agency Employment law in the Czech Republic. Firstly I present the state, when this institute wasn't included in our legal system, then I put mind to the current law. This chapter includes also a detailed analysis of the International Labour Organisation...

Pracovní smlouva / Contract of employmentHudečková, Lucie January 2014 (has links)
The topic of contract of employment is still contemporary issue of czech labour law. Nowadays contract of employment is under the influence of a technical and societal progress which demands frequent and important legal changes. There is also the substantial influence of contemporary European tendency to make labour law more flexible with maintaining the high level of social security standards of employees. This tendency is widely known as "flexicurity". The thesis is divided into three chapters. The chapter deals with common principles of labour law which are crucially important for understanding the issue of contract of employment. For this reason, the charter contains explaining the term "labour law" and its object, principals of labour law, the relations between the Labour Code and Civil Code, the defining the term of dependent work. This term is strongly connected with the issue of disimulation of legal act. The Chapter Two discuss a contract of employment as an agreement between employees and their employers, which have some autonomy of will which is limited by law. One section deals with nullity of contract of employment or articles of contract, in other part I try to explain the legal form of contract of employment. The last chapter is concerned with content of contract of employment. In subsection...

Ochrana zaměstnance při skončení pracovního poměru / Protection of Employees upon Termination of the EmploymentBenešová, Lucie January 2016 (has links)
The theme of this thesis is the protection of the eployees upon termination of the employment. The aim is to comprehensively assess the current legislation of termination of empoyment, with regard to the degree of protection that is provided to employees. It deals with the protection of employees, their position but also the claims related to the termination of the employment relationship. This thesis is dividend into five chapters, the first of which relates to the functions of labor law with an emphasis on the function of protection as a core function of labor law. With regard to weaker position of the employee to the employer, it is clear that labor law generally tries to balance this inequality or in some way eliminate it in order to provide the highest level of security. The second charter presents the core of this thesis and deals with the varoius types of termination of employment. It contains their assessement in relation to ensure adequate protection of employees but also the positives and negatives of legislation including possible aplication problems that are occured in practice. The emphasis is placed primarily on the termination of the employment relationship in view of the fact that the need to ensure a sufficient level of protection of employees in this unilateral termination method...

The deal : employment relations in growth-oriented, high-tech start-ups : an employee perspectiveAchtzehn, David January 2015 (has links)
The aim of this thesis is to explore employment relations in young, growth-oriented, technology-driven (high-tech) start-ups. It takes a closer look at the exchange relationship between founders and their first employees in this specific context. At its core, the research is interested in employees motivation to work for a growth-oriented start-up and their understanding of the employment deal. The study uses the psychological contract as an analytical framework to gain deeper insights into individuals perceptions of this deal. The research is embedded within an interpretivist paradigm and includes eight case studies involving growth-oriented high-tech start-ups in Berlin and London. For each case, in-depth interviews with three full-time employees as well as the founder(s) were conducted. The findings of this thesis demonstrate that the employment deal in growth-oriented start-ups is a short-term, faith-driven contract, which differs substantially from the current understanding of the psychological contract. In contrast to the long-term or open-ended contract often offered by larger, more established organisations, this deal has a defined expiration date . Moreover, the findings challenge the current understandings on remuneration, relationship building and power dynamics within growth-oriented start-ups and add to the literature by offering a re-conceptualisation of the psychological contract. This thesis helps to inform prospective employees about the advantages and challenges of joining a start-up and encourages entrepreneurs to further tailor their management and compensation strategies.

The nature of perceived discriminatory experiences of homosexual individuals at work20 May 2015 (has links)
M.Com. (Industrial Psychology) / In line with recent media reports, it is apparent that homosexual individuals are treated unfairly in a variety of contexts. Yet, little is known regarding the discrimination of homosexual employees in the South African workplace. The objective of this study was to examine the nature of discriminatory experiences of South African homosexual employees. In this study a qualitative approach was used with hermeneutic phenomenology as the method of data analysis. Data were collected through the means of semi-structured interviews with ten homosexual employees from various industries within the Gauteng province. The findings suggest that homosexual individuals do experience discrimination at work and that the experiences of discrimination at work are slightly different for gay employees than for lesbian employees. Three themes generated for gay employees (workplace bullying, the use of prejudice and stereotypes, and problems with people management practices, policies and procedures), while four themes were generated for lesbian employees (workplace bullying, the use of prejudice and stereotypes, problems with people management practices, policies and procedures, and sexual harassment). The contributions of the study will be to provide much needed awareness and understanding of workplace discrimination against homosexual employees. It is hoped that the findings of this research will lead to a re-examination of human resource practices and policies regarding diversity training and anti-discrimination.

SITUACE NA TRHU PRÁCE V JIHOMORAVSKÉM KRAJI V OBDOBÍ HOSPODÁŘSKÉ RECESE / SITUATION OF THE LABOR MARKET IN THE SOUTH MORAVIAN REGION IN THE TIME OF ECONOMIC RECESSIONMáčalová, Pavlína January 2010 (has links)
By the end of the year 2007 and the beginning of the year 2008, the financial crisis struck the world market and over time the labor market as well. The thesis focuses on the analysis of establishing the labor market in the South Moravian region by comparing districts Brno-city and Vyskov. In the theoretical part, I explain relevant definitions in the field of labor markets and a definition of economic recession. Next, I discuss the South Moravian region's characteristics, which promote the district's means to resist the recession. I point out its weaknesses in the labor market as well. The practical part compares general indicators of labor markets in the districts Brnocity and Vyskov. The measures used are employment and unemployment rates. Towards the end, the thesis shifts its focus on employment policies. The Active Employment Policy is the main subject of concern in this chapter. Directors of various labor offices commented on the Active Employment Policy and its means of control, which helped clarify some inconsistencies resulting from the statistics.

Learning experiences of female artisans in the automotive industryTeti, Thandokazi Ndileka January 2017 (has links)
A research report submitted to the School of Governance, University of Witwatersrand, in partial fulfilment (25%) of the requirements for the degree of Master of Management (Public and Development Management)
Johannesburg, 2016 / Gender inequality persists in artisan employment in South Africa as males continue to outnumber females significantly in artisan employment and the trends point to highly gendered industry participation. Females who manage to enter artisan occupations in the highly gendered workplace are faced with historically ingrained attitudes of males towards females. Discriminatory practices, social norms and persistent stereotypes shape the females’ learning experience.
Therefore, the purpose of this research is to explore the learning experiences of female artisans in the South Africa automotive industry, during the work-based phase of their apprenticeship. A qualitative exploratory research study approach was adopted using semi-structured face–to-face interviews. Fourteen female apprentices, learnership candidates and artisans were interviewed, including two industry training experts. Purposive and snowball sampling techniques were used.
The findings revealed that the general experiences of the female participants were challenging. The quality of learning they received is not equal to that of their male counterparts and the workplace culture consists of prejudice, gender discrimination, racial discrimination, stereotypes and barriers to employment. Interestingly, the participants were uncritical of the experience of gender discrimination, although, they were very critical of racial discrimination. This suggests a need to conduct and create awareness sessions about gender discrimination in the industry for both genders. / MT 2017

Living in and out the closet: an exploration of lesbian identity in the workplaceDestanovic, Justine January 2016 (has links)
M.A. (Clinical Psychology), University of the Witwatersrand, Faculty of Humanities / In 1996 South Africa was the first country in the world to protect sexual minorities from discrimination in its Constitution. The benefits of a liberal constitution cannot go unacknowledged, however, negotiating lesbian identity within the work context is still a challenge due to the pervasive stigma attached to homosexuality, as well as the remnants of South Africa’s stormy, oppressive political history. Lesbian woman in South Africa grow up in a society which remains predominantly patriarchal and conservatively religious and where the heterosexual assumption, the idea that one is ‘straight’ unless otherwise stated, is continually confirmed and perpetuated in a variety of contexts, including the occupational environment.
It is within this setting that lesbian women woman must attempt to negotiate and continually, in varying degrees, and not always by choice, take part in the coming out process in different social spaces. In interviews with seven self-identified lesbian women, the dynamic process of coming out within the occupational environment, was explored in relation to and within relevant cultural, historical, familial and social contexts. All participants had disclosed their sexual identity within the work place, in varying degrees. Key aims of the research were exploring the negotiation of lesbian identity in various occupational contexts as well as identifying strategies used to negotiate the work environment and lesbian identity / MT2017
