59 Liquidation of the inheritance in Czech and Austrian legislation This diploma thesis is focused on the over-indebtedness of the estate in two countries, namely in the Czech Republic and in the Republic of Austria. Its main goal is to analyse the current situation, compare the differences between the two countries and point out the problems of current legislation. In this thesis, there was mostly used descriptive method, in combination with the comparative method. The Austrian legislation was chosen for comparison because of the history that unites the two countries. Austria-Hungary, of which both countries were part, provided the basis for the current standards of both countries. The text of the diploma thesis itself is divided into two main parts. The first of them is focused on legislation in our territory. At the beginning, the reader is acquainted with the development of legislation, which ends with the currently valid laws. Furthermore, the estate proceeding is described, thus its process, the main institutes and the position of the notary as a court commissioner. Then, the assumptions under which the liquidation of the inheritance is ordered are analysed and also its influence on further proceedings. Evolving an Effective Legal Protection for Women’s Inheritance Rights in Ghana: A Need for Legal Reforms and Implementation

This thesis analyzes the inequality women face in the inheritance regime in Ghana. The existing legal framework which includes customary law is fraught with challenges that hinder women from claiming a fair share of their inheritance rights. Existing customary laws conflict with statutory law. Customary law contains aspects that contradict principles of equality espoused in statutory law. Additionally, the court relies on “judicial customary law” which contains old inheritance practices that do not reflect socio-economic changes. Finally, the judiciary in Ghana also uses the repugnancy doctrine in the interpretation and application of customary law. However, the repugnancy doctrine is outdated and constitutes a major hindrance for women in claiming a fair share of their inheritance rights. Drawing on postcolonial theory, intersectional feminism, law and society and sociology of law theories, this dissertation investigates and addresses the injustices associated with women’s rights of inheritance in Ghana. A major goal is to provide viable pathways that will ensure an equitable framework in the sharing of intestate property.

Inheritance of resistance to selected pyrethroid insecticides in <i>Blattella germanica</i> (Dictyoptera: Blattellidae)

Four insecticides, cypermethrin, fenvalerate, permethrin and phenothrin were employed to study the inheritance of resistance to pyrethroid insecticides in the Seasons strain of <i>Blattella germanica</i>. This resistance was found to be an autosomal, probably monofactorial character, not linked with the black body or orange body mutants that identify linkage groups 4 and 6. The trait was found to be incompletely recessive with a degree of dominance of -0.57. It was established that the gene is probably separate and distinct from the known trait <i>R-pyreth</i>, a pyrethrins resistance gene linked with black body in the linkage map of this organism. Future studies are recommended to further delineate this resistance and suggestions are made for possible avenues to pursue. / Master of Science

The thesis deals with one of the reinstated institutes which are introduced by act number 89/2012 Sb., that is by the new Civil Code and it is the institute of Legacy. This work is divided into five chapters, where firstly it discusses the characteristics of this institute in Roman Law and compares it with the institute of fideicommissum. In addition this work deals with characteristics of this institute in Italian law from the times of Unification of Italy up to the present day, therefore it briefly deals with both of the Italian civil codes. The most extensive chapter deals with the institute in our own legal history, especially about its form in ABGB, the "warp" and the "middle" code and it is followed by chapter, which deals with our new Civil Code, which has returned this institute into our Inheritance Law. The whole work is concluded by a comparison of the similarity of this institute in Italian and Czech legal order. This work is elaborated on positive note and its aim is to show that this is very practical institute, which is in both ours and Italian law very similar even though it has been developing for centuries. I believe that it could become normal part of donation mortis causa.

Analysing the financial fate of the surviving spouse in French and Ontario law reveals him or her to be both a partner and an heir. The patrimonial union between the spouses is indeed a partnership which is terminated by the death of one spouse. Moreover, marriage introduces each spouse into his or her partner's family for the purposes of succession. The dual character of status of the surviving spouse is the basis of the argument, advanced in this thesis, that this duality represents an important commonality between the French and Ontario legal systems, notwithstanding the disparities between the two. One of these disparities is the surviving spouse's obligation, in Ontario, to choose between his or her matrimonial and inheritance rights, except when the deceased has expressly provided that he or she would not have to make this choice. Thus, while French law permits the surviving spouse to deduct the amount of his or her inheritance portion from the deceased's assets, even once the financial benefits of the marital partnership have been apportioned, Ontario law seems to be unable to distinguish between the partition of the marital partnership and the deceased's succession. After examining, in particular, the surviving spouse's rights pursuant to mandatory and suppletive rules of law, from the twin perspectives of spouse and heir, the thesis explores some examples of the tools used by spouses for estate planning. In particular, marriage contracts and life-insurance can dramatically affect, for better or worse, the fate of the surviving spouse.
