在現行法律中存在著許多空白刑法構成要件之條文規定，這些規定有無違背罪刑法定原則、是否逾越憲法的界限，空白刑法構成要件的憲法正當性界限何在？填補空白刑法構成要件之具體規範有變更時，究竟是事實變更還是法律變更？對於空白刑法構成要件填補規範之認識有錯誤時，能否阻卻故意之成立？筆者將從目前的學說與相關實務之見解切入，深入探討相關的問題，希望能找出一個在實務上可操作的標準。
