世界上之人民參與審判制度大體分成「陪審制度」與「參審制度」，前者主要代表國家為英國、美國，後者原則上為大陸法系國家所採取，本文挑選了包括我國在內之數個制度內容不盡相同的國家，針對人民參與審判制度當中之基本、重要爭點，探討其間之差異，而我國司法實務為了提升人民對於司法審判之公信力，目前正積極推動「人民觀審制度」，其所採取之表意不表決方式使其與上開之陪審、參審制度有著本質上的重大不同，本文之主要目的在於分析觀審制度之利弊得失，並與上開數個國家之人民參與審判制度作一比較，使整個觀審制度更臻完善，最後，由於世界上絕大部分國家僅將人民參與審判制度適用於刑事訴訟程序，究我國之民事訴訟程序得否一併為適用，亦提出本文之初淺見解。
