Análise do regime financeiro do processo civil como limite teórico e prático da tutela jurisdicional

The author presents the differentiation between direct and indirect costs from the social and economical ones on Civil Procedure. Also, models of separation of costs in the North American, English and Continental European law, as well as their techniques of division between litigants are focused. The Financial Regime of Brazilian Civil Procedure is analyzed through the separation between procedure costs and attorneys’ fees. In the topic of procedure costs, types of costs, duty by the payment in advance, responsibility for payment, reimbursement of the costs, costs that can not have a reimbursement are identified. Concerning attorneys’ fees, their legal nature, their creditors and debtors, together with their form of stipulation are investigated. Finally, hypothesis for exemption and postponing financial costs in different rules of Procedure are presented. / Esta dissertação analisa, à luz do Direito Processual Civil brasileiro, os custos financeiros da demanda judicial. Distinguem-se os custos financeiros diretos e indiretos dos custos sociais e econômicos do Processo Civil. São enfocados os modelos de divisão dos custos no Direito norte-americano, inglês e europeu continental, bem como as suas técnicas de divisão entre os litigantes. O regime financeiro do Processo Civil brasileiro é analisado a partir da divisão entre despesas processuais e honorários advocatícios. No tópico das despesas processuais, são identificadas as espécies de despesa, o dever de adiantamento, a responsabilidade pelo pagamento, o ressarcimento dos custos e os pagamentos irrepetíveis. No que diz respeito aos honorários advocatícios, é investigada a sua natureza jurídica, os seus credores e devedores, assim como a sua forma de fixação. Por derradeiro, são apresentadas hipóteses de isenção e de diferimento dos custos financeiros nos diferentes procedimentos processuais.
