From the design of the context of legal, regulatory and constitutional protection of industrial property rights for plant varieties, the study aims to answer which are the limits of protection of the patents on genetically modified seeds process and if it is applicable the law of patent exhaustion in the case of transgenic soybean Roundup Ready? due to its technology self-replication nature. From the analysis of the case Monsanto v. Bowman judged by the U.S. Supreme Court, and made the necessary caveats regarding the legal system in the field of industrial property in Brazil, the work investigates whether the application - or not - of the doctrine of exhaustion of patent rights, depending on the specific case, is intrinsically related to the very social function of intellectual property, which in this work is considered as a limiting principle of the exclusive right that allows, ultimately, the reconciliation of fundamental rights in collision. / O presente trabalho desenvolve uma reflex?o cr?tico-jur?dica acerca do tema da prote??o da propriedade industrial das variedades vegetais no contexto da biotecnologia agr?cola. A partir do delineamento do contexto de prote??o jur?dico-normativo e constitucional da propriedade industrial de variedades vegetais, o estudo objetiva responder quais os limites de prote??o do processo de patenteamento de sementes transg?nicas e se aplic?vel a doutrina de exaust?o de patente no caso da soja Transg?nica Roundup Ready? em face da natureza autorreplic?vel de sua tecnologia. A partir da an?lise do caso Bowman versus Monsanto julgado pela Suprema Corte Americana, feitas as devidas ressalvas em rela??o ao sistema legal em mat?ria de propriedade industrial do Brasil, o trabalho investiga se a aplica??o ou n?o da doutrina de exaust?o de patente, a depender do caso concreto, est? intrinsecamente relacionada ? pr?pria fun??o social da propriedade industrial, considerada neste trabalho como princ?pio limitador do direito de exclusividade que permite, em ?ltima inst?ncia, a concilia??o de direitos fundamentais em colis?o.
