Informe Jurídico sobre la Sentencia 197/2023 del Exp. N.° 00238-2021-PA/TC (Caso AOE)

El presente informe jurídico analiza la Sentencia del Expediente N.° 238-2021- PA/TC. Para ello, se basa en la siguiente pregunta principal: ¿La medida de prohibir la distribución gratuita del AOE por parte del MINSA implica una vulneración de los derechos a la autodeterminación reproductiva (DAR) y a la igualdad de las personas con capacidad de gestar (PCG)? Para responder la misma, se ha utilizado legislación nacional, así como tratados internacionales. Asimismo, en relación a la jurisprudencia se contó con las sentencias de los Expedientes N° 7435-2006-PC/TC, N° 2005-2009-AA/TC y N° 3378-2019-PA/TC del TC, así como la sentencia del caso Manuela y otros vs. El Salvador y la sentencia del caso I.V. vs. Bolivia de la Corte IDH. Finalmente, tras el análisis correspondiente, se concluye que la prohibición de distribuir gratuitamente el AOE implica una violación del DAR y a la igualdad y no discriminación, afectando desproporcionadamente a PCG de bajos recursos económicos. / This legal report analyzes Judgment 197/2023 of Case No. 238-2021-PA/TC. It is based on the following primary question: Does the Ministry of Health's prohibition on the free distribution of emergency oral contraceptives imply a violation of the rights to reproductive self-determination and to equality of persons with the capacity to gestate? The analysis uses national legislation and international treaties. Additionally, jurisprudence was considered, including the rulings of Cases No. 7435-2006-PC/TC, No. 2005-2009-AA/TC, and No. 03378- 2019-PA/TC, as well as the ruling in the case of Manuela and Others vs. El Salvador and the ruling in the caso of I.V. vs. Bolivia of the I/A Court H.R. Finally, after the corresponding analysis, it is concluded that the prohibition on the free distribution of emergency oral contraceptives constitutes a violation of the right to reproductive self-determination and to equality, disproportionately affecting economically disadvantaged persons with the capacity to gestate.
