The figure of international arbitration is briefly defined as a method of conflict resolution in the international level, alternative to the Administration of Justice, emphasizing its neutrality, speed and confidentiality.This article shows the new challenges faced by arbitrators, in terms of choice, length of process and efficiency in decision making. In addition, it proposes nine solutions to improve arbitration performance and abbreviate the process of taking decisions. / La figura del arbitraje internacional, es definida brevemente como un método de resolución de conflictos en el ámbito internacional alternativo a la Administración de Justicia destacando su neutralidad, rapidez y confidencialidad.Este artículo pone de manifiesto los nuevos retos que afrontan los árbitros, en cuanto a la elección, duración del proceso y eficiencia en la toma de decisiones.Además, propone nueve soluciones para mejorar el desempeño arbitral y acortar la emisión de decisiones.

Modern commercial relations have been making their dynamics more complex over the years and have made of arbitration the best way of conflicts resolution. One of the most complex changes has been the addition of elements in national and international arbitration agreements. It is also of fundamental importance to define who are the parties involved in the arbitration, both parties involved and non-signatories.In this article, the author analyzes the figure of third parties who have not subscribed to the arbitration agreement in light of the Peruvian Arbitration Law.In addition, the author proposes solutions for its better regulation. / Las relaciones comerciales modernas han ido complejizando su dinámica a través de los años y hacen del arbitraje el medio de solución de controversias por excelencia. Uno de los cambios más complejos ha sido el agregado de elementos en los convenios arbitrales en el ámbito nacional e internacional que deben analizarse. Es, además, de relevancia fundamental definir quiénes son las partes que intervienen en el arbitraje, tanto las partes involucradas como los no-signatarios.En este artículo, el autor analiza la figura de los terceros que no hayan suscrito el convenio arbitral a la luz de la Ley Arbitral Peruana, además de proponer soluciones para su mejor regulación.

The topic of this thesis is arbitration proceedings in the Czech Republic. In the introductory chapter arbitration is generally described, with definition of its characteristics in comparison with the ADR methods and regular court proceedings. Four basic theoretical standpoints concerning the arbitration proceedings are introduced. Arbitration is divided into general and specific arbitration as well as institutional and ad hoc. In the second chapter the issue of arbitrability is described- specifically the conditions of its formation. The third chapter focuses on the arbitration agreement, beginning from the inception, including its content and ending with cases when the agreement is void. Arbitrator, including requirements concerning the person, such as confidentiality, independence, and impartiality, is contained in the fourth chapter. It also includes arbitrator's appointment and remuneration. The fifth chapter deals with the arbitration proceedings in concreto. Basic principles governing the arbitration are outlined, following with initiation of legal action including further motions and evidence. The theme of this thesis is the arbitration proceedings in the Czech Republic, which is one of the alternative disputes resolutions. The goal of this thesis is to provide a complete summary of legal regulation of the arbitration proceedings. The thesis is divided into eight chapters. The first three chapters deal with general issues of the arbitration proceedings. The first chapter which is further subdivided into six subchapters is focused on the basic definition of the arbitration proceedings, its theoretical concepts, its advantages and disadvantages, as well as its different types. The second chapter provides a summary mainly of national legal regulation. Chapter three explains the objective conditions under which a certain range of disputes can be heard and decided in the arbitration proceedings, including some specific examples. Chapter four is concerned with the arbitration agreement which is the major institute and the basis condition of the arbitration proceedings. 77 Resumé The topic of this thesis is Relation between Arbitration proceedings and Rules of Civil Procedural Law. The thesis focuses on arbitration regulated by Act No. 216/1996 Coll., On Arbitration Proceedings and Enforcement of Arbitral Awards and looks for similarities in the proceedings in front of the ordinary courts, which is primarily regulated by the Act no. 99/1963 Coll., Civil Procedure Code. Arbitration uses provisions of the Civil Procedure Code in cases where the legislation provided by Act. No. 216/1996 is missing completely or is not sufficient. The work is divided into seven main chapters, which are further divided into sub- chapters. The first chapter describes rules for procedural managements of the arbitration proceedings. It draws attention to the legal possibility for the parties to agree on their own rules of procedure in the management and suggests that the parties' agreement may also directly refer to the legal provisions of the court proceedings. The next two chapters deal with theoretical introduction to the use of the Code of Civil Procedure in arbitration. The topic of this thesis is arbitration proceedings in the Czech Republic, which is nowadays the most significant alternative to the civil court proceedings. This thesis aims to give a summary of every fundamental institute of arbitration proceedings, with its detailed characteristics, including the comprehensive description of contemporary legislation. This thesis is divided into ten chapters, where the author describes individual institutes of arbitration proceedings in detail. O presente estudo visa a analisar a arbitragem expedita a partir da ótica da Análise Econômica do Direito, como ferramenta para verificação dos custos de transação e de oportunidade na escolha do procedimento a adotar. Para tanto, utilizou-se pesquisa bibliográfica, levantamento de dados e análise legislativa e regulamentar. A pesquisa contribui na identificação do procedimento como modalidade de acesso das empresas à arbitragem mediante excelente relação de custo-benefício, a depender da quantidade e qualidade das informações a que as partes se dispuserem a apresentar entre si e ao julgador em um curto espaço de tempo. Como resultado, conclui-se que pela Análise Econômico-Jurídica da Arbitragem Expedita é possível demonstrar que o procedimento expedito se apresenta como ótimo redutor de custos de transação e de oportunidade, trazendo vantagens às partes que necessitam de um julgamento especializado célere, nas causas de baixa complexidade, não sendo indicado adotá-lo nos contratos multipartes. / Expedited arbitration is an appropriate and private method of conflict resolution, with international origin and progressively adopted in Brazil by virtue of legislative and regulatory permission, to resolve issues of low complexity and low values involved. This study aims to analyze expedited arbitrage from the perspective of the Law & Economics, as a tool to verify transaction and opportunity costs in choosing the procedure to adopt. For this purpose, bibliographic research, data collection and legislative and regulatory analysis were used. The research contributes to the identification of the procedure as a way of accessing companies to arbitration through an excellent cost-benefit relationship, depending on the quantity and quality of the information that the parties are willing to present to each other and to the judge in a short time. As a result, it can be concluded that the Economic-Legal Analysis of Expedited Arbitration can demonstrate that the expedited procedure presents itself as an optimal transaction and opportunity cost reducer, bringing advantages to parties who need a speedy specialized judgment in the causes of low complexity, and it is not recommended to adopt it in multiparty contracts.

This thesis discusses the alternative dispute resolution methods in trade relations. The main objective of this thesis is to describe and analyze ADR as a group of methods used to resolute disputes with focus on two main methods - mediation and arbitration. My objective is to describe the main principles of ADR, to compare their main advantages and disadvantages and to analyse the process of resoluting disputes by these methods. Another objective is to evaluate and analyze the development of ADR in the Czech Republic, their legal regulation and its current status. A short part of the thesis concerns about regulation of mediation in the EU and the analysis of implementation of the European Parliament and Council Directive 2008/52/EC dated May 21, 2008 to national legislation. Thesis is divided into five separate chapters. The first, introductory chapter only briefly discusses about dispute and conflict and ways they can be solved. The second chapter already characterizes ADR as a group methods of dispute resolution, its main principles, advantages and disadvantages and finally briefly describes some of the ADR. The third and fourth chapter focuses on the mediation, its principles, advantages, disadvantages, the mediation process and mediator. It monitors the development of mediation in the Czech republic and the current situation in the legal regulation of mediation in the country. The last chapter deals with arbitration. It describes its basic principles, advantages and disadvantages again. The conclusion discusses the czech Arbitration law and the forthcoming amendment.
