Atsižvelgiant į tai, kad siekiant teisingai kvalifikuoti kyšininkavimą, būtina išanalizuoti jo požymius, o iki šiol Lietuvos baudžiamosios teisės literatūroje dažniausiai buvo nagrinėjami tik atskiri šio nusikaltimo požymiai, taip pat tai, kad po 2011 metų BK XXXIII skyriaus pataisų dalis šių minčių nebetinka dabartinei BK redakcijai, šiame magistro baigiamajame darbe, nagrinėjami kvalifikavimo problemų keliantys kyšininkavimo požymių aspektai. Pirmoje dalyje aptariamas šio nusikaltimo reglamentavimas tarptautiniuose ir Europos Sąjungos teisės aktuose, palyginamas juose ir BK įtvirtintų nuostatų suderinamumas. Antroje dalyje nagrinėjami objektyvieji ir subjektyvieji kyšininkavimo požymiai. Aptariamos šios nusikalstamos veikos dalyko, pavojingos veikos, subjekto, kaltės ir kitų požymių sampratos, jų atribojimo tarpusavyje bei kitos problemos, kylančios kvalifikuojant kyšininkavimą. Paskutinėje dalyje nagrinėjami kyšininkavimo atribojimo nuo kitų nusikalstamų veikų valstybės tarnybai ir viešiesiems interesams pagrindai. / In pursuance of right qualification of bribery it is very important to analyse the features of this crime. Till now the majority of Lithuanian authors have examined only particular features of bribery. Also the Criminal Code of Republic of Lithuania changed in 2011 and some their ideas are not topical today. Because of these reasons, in this master work the author investigates the bribery features which raise the problems of qualification of this crime. In the first part of work the regulation of bribery according to international and European Union documents is discussed. Also the provisions of these documents and the Criminal Code of Republic of Lithuania are compared. In the second part the objective and subjective features of bribery are analysed. There is disputed the conceptions of matter, subject, guilt and other features, delimitation of each other and other problems connected with qualification of bribery. In the last part the grounds of delimitation between bribery and other crimes of XXXIII chapter of the Criminal Code of Republic of Lithuania are analysed.

Essays using Experimental Methods to Answer Social ChoiceAfreen, Evana 11 May 2015 (has links)
This dissertation includes three chapters that utilize experimental methods to answer questions relating to social choices. Social choice is a broad category that can incorporate an individual’s choices when it comes to charitable giving, providing a public good or creating externalities through one’s choices.
In the first chapter “To Be or Not To Be Corrupt: An Experimental Study on Bribery” I designed a modified version of the bribery game used in Abbink et al. (2002) to study whether information on the prevalence of bribery activity within the experimental environment has an effect on behavior. In addition it also tests whether this prevalence effect can be reduced by implementing a strict punishment.
In the second chapter “Can Cooperative Behavior Improve Efficiency in Public Good Provision?” laboratory experiments are used to test whether information about the cooperative behavior of the group members in a trust game affects contribution to a public good game. The first part of the design utilizes a trust game to measure the cooperative behavior of the subjects. This information is provided in the public goods game to see if there is an effect on contributions. The essay also looks at if there is an effect on contribution, and if that effect lasts over time or it merges towards a selfish-man equilibrium of no contribution.
The third chapter “Means and Ends in Charitable Giving for Environmental Protection: A Discussion” conducts a discussion on the charitable giving literature related to environmental charities and builds a simple model of warm glow to show that the attributes of an environmental charity may affect giving. The model can also be used to consider attributes on how the money is used. For example, whether there is a difference when a market-based mechanism like Payment for Environmental Services (PES) is used versus more traditional mechanism like education on alternative livelihood. It then proposes a possible design for a field experiment to test the hypotheses.

PROTECTION AGAINST CORRUPTION AND BRIBERY AND THEIR PREVENTION The purpose of this thesis is to analyse the phenomenon of corruption and to describe the relevant legislation, which either states the illegality of the matter or is important as a part of the actions taken against corruption. The main reason why the author has chosen this topic is possibly the frustration about the strong corruption climate in the Czech Republic and also the fear that the country is - concerning this issue - not moving forward at all. The motive was to find out the reasons of this situation and to analyse whether the legislation covering this area is sufficient. This work consists of an introduction, three chapters, each of them dealing with different aspects of the topic, and the conclusion. In the introduction, the author describes the reasons for choosing the topic and summarises the content of the thesis. The purpose of the first chapter, which consists of four parts, is a description of the term "corruption". It gives a number of definitions and tries to further explain the meaning by presenting different types of corruption. 1 Summary The thesis deals with certain aspects of corruption and its prevention. It focuses mainly on whistleblowing as an instrument of corruption control. The thesis is structured into an introduction, three chapters and conclusion. The first chapter contains a general introduction to the corruption issue. With the aid of several historical examples of corruption cases in various social systems, I attempt to emphasize the complexity and ubiquity of this phenomenon. Further on, the chapter is concerned with clarifying the notion of corruption as well as other key concepts, such as bribery, lobbing etc. The second chapter provides an overview of Czech substantive anti-corruption criminal law with special focus on bribery offences incorporated in Sections 331 to 333 of the Czech Criminal Code. Two excursions are made within this chapter. The first covers the topic of gift acceptance by civil servants based on the new Czech Civil Service Act as well as the potentially corruptive effect of such practice, if allowed even to a limited extent. The second excursion discusses the fundamental differences between lobbing and the criminal offence of indirect bribery according to Section 333 of the Czech Criminal Code.
