A critical evaluation of the preferential procurement strategy and enterprise development strategy of a major motor manufacturer in the Eastern Cape

This research is born out of recognition of the challenges Black Economic Empowerment (BEE) in the private sector faces in South Africa, with preferential procurement being one of the components of South Africa's Broad Based Black Economic Empowerment Strategy. Over the past years, South Africa has witnessed the birth of a new economy, one that allows for investment in its people, makes provision for sustainable growth through skills transfer and development, and ensures economic empowerment. The focus of this research is the Preferential Procurement strategy implemented at DaimlerChrysler South Africa (DCSA) as part of its overall Black Economic Empowerment strategy, the perceptions and expectations of how the current BEE preferential procurement strategy should work versus the perceived performance of how it is working. An official definition of Black Economic Empowerment is presented in the study, followed by barriers to growth of BEE suppliers. The aim of defining Black Economic Empowerment is to provide a good reference point against which an organization like DaimlerChrysler can assess the implementation of its preferential procurement programmes. Having discussed the above, there will be a reflection on government scorecard and a brief discussion of the two charters namely, mining and financial services charter. The study also presents the following requirements for a successful BEE corporate strategy: Strategic intent; External Balanced Scorecard; Financial Assistance; Skills development; Communication. A research methodology for conducting this study and data analysis is presented, followed by limitations of the study and recommendations for further research. It is expected that the knowledge gained from this study will help to I. Demonstrate the need to change perceptions and behaviour regarding Black Economic Empowerment. 2. Assist procurement officials to include BEE objectives into their procurement strategy. 3. Identify policy implications and assist in improving DCSA's Black Economic Empowerment Procurement strategy.

The taxation of black economic empowerment transactions, with specific reference to the financial sector

There has been some concern that the pace of expectations being built up regarding the transfer of ownership of the economy into the hands of the previously disadvantaged was not allowing for the due diligence and analysis of the implications of such transactions. Tax legislation relating to the transfer of assets is also not seen to be consistently conducive to this process. The focus of this thesis is taxation and a critical analysis of how the current tax legislation affects most of the transactions which usually form the basis of black economic empowerment. It is argued that tax policy is one of the fundamental instruments available to government to encourage the process of black economic empowerment. It is therefore important to assess whether or not current tax legislation is supportive of the process of black economic empowerment and to suggest ways in which it can be amended to serve this purpose. By means of a literature review and a case study of a Black Economic Empowerment deal in the financial sector, the thesis examines various sections of the Income Tax Act, 58 of 1962, which may have a bearing on black economic empowerment transactions and structures, including corporate restructuring rules, the taxation of trusts, inter-company loans, the use of hybrid financial instruments, the taxation of small business corporations, employee share incentive schemes, connected persons rules and value-shifting arrangements, the general deduction formula and the deductibility of interest incurred on amounts raised to acquire shares. It appears that although some aspects of the current tax legislation lend themselves to assisting black economic empowerment transactions, there are still areas where much improvement is required. / KMBT_363

Passing the spear : a grounded theory study of the influence of family business value sets on succession planning in black family-owned businesses

Literature suggests that a small number of family businesses are able to make the transition from the founder to other family members with a common reason cited being the lack of planning. This study aims to build understanding of leadership succession in family businesses by focusing on the influence of a founder's family business value set on the succession planning process in Black family-owned businesses. Using the Strauss and Corbin (1990) grounded theory method, this study develops a theory of succession planning of Black familyowned businesses labelled Passing the Spear which is comprised of three stages based on an analysis of 21 qualitative interviews. The Spear was an analogy used to represent both the values of the founder and the family business, thus in Passing the Spear, founders where essentially performing a dual transfer of their values and leadership to the successor. The implementation of the process Passing the Spear was influenced by the family business value set of the founder, which in this study, were labelled as Traditional, Progressive, and Transitional. These value sets were distinguished by their behaviour regarding their choice of successor where founders with a traditional value set exhibited gatekeeping behaviour, while the behaviour of founders with a progressive value set was labelled navigating, and finally, founders with a transitional value set demonstrated behaviour labelled exploring. Furthermore, it was found that after the successor had been chosen, founders appeared to follow a generic succession planning process, however, the ease and timing of implementation was influenced by the family business context, evidence of being proactive and the degree of family business resilience. The process of Passing the Spear comprised of three stages of (a) Showing the spear where the founder's focus is on the induction and socialization of the successor using the strategies of bringing the successor into the family business and managing the family-business interface using relationships; (b) Explaining the spear entailed founders using the strategies of sharing knowledge and teaching the successors about the family business; and ( c) Sharing the spear was where founders focused on empowering the successors by implementing strategies of sharing responsibilities and learning from the successor.The process provides insights into the influence of family business values on the succession planning process and can be useful for founders of Black family-owned businesses in planning for succession in their businesses. In addition, the study provides another perspective of succession planning and offers a contribution to the literature for understanding succession in Black family-owned businesses.

Trade union investment schemes: a blemish on the social movement unionism outlook of South African unions?

South African trade unions affiliated to Congress of South African Trade Unions (COSATU) have taken advantage of the arrival of democracy and newly found opportunities available through Black Economic Empowerment to venture into the world of business by setting up their own investment companies. The declared desire behind these ventures was to break the stranglehold of white capital on the economy and to extend participation in the economic activities of the country to previously disadvantaged communities. Using the National Union of Mineworkers and the Mineworkers’ Investment Company as case studies, this dissertation seeks to determine whether unions affiliated to the Congress of South African Trade Unions (COSATU) are advancing the struggle for socialism through their investment schemes. Secondly, the dissertation determines whether, in the activities of the schemes, internal democracy is preserved and strengthened. The theoretical framework of this dissertation emerges from arguments advanced by Lenin and Gramsci on the limitations of trade unions in terms of their role in the struggle against capitalism. In addition, the argument draws on the assertions by Michels regarding the proneness of trade union leadership to adopt oligarchic tendencies in their approach to leadership. Of interest is how, according to Gramsci, trade unions are prone to accepting concessions from the capitalist system that renders them ameliorative rather than transformative. Drawing from Michels’ ‘iron law of oligarchy’, the thesis examines whether there is space for ordinary members of the unions to express views on the working of the union investment companies. By looking at the extent to which the investment initiatives of the companies mirror the preferences of the ordinary members of the unions, one can determine the level of disjuncture between the two. The study relies on data collected through interviews and documentary material. Interviews provide first-hand knowledge of how respondents experience the impact of the investment schemes. This provides a balanced analysis given that documents reflect policy stances whereas interviews provide data on whether these have the stated impact. What the study shows is a clear absence of space for ordinary members to directly influence the workings of union investment companies. It is also established that, in their current form, the schemes operate more as a perpetuation of the capitalist logic than offering an alternative system.

The impact of economic downturn on black economic empowerment and banks

The purpose of this treatise is to ascertain the impact of economic downturn on Black Economic Empowerment (BEE) and Banks. This has been sparked by the huge speculations in the market as to what will happen to BEE and how will the banks cope in general with the impact of this scourge. It is imperative to understand the influence of the 2008+ economic downturn on socio-economic reconstruction and development in South Africa and the black economic empowerment and its funding mechanisms. The treatise has two phases the, namely the theoretical phase and a bit of narrative phase. In the theoretical phase the research study interrogates what the literature review reveals about the economic downturn, BEE as well as performances of different banks across the world. This shows the economic impact that the banks have had to endure during the economic downturn. This resulted in stock markets losing their value. The dividend earners were significantly affected including a sizeable number of BEE companies. The BEE companies are perceived to be too reliant on debt on to finance their deals and this treatise will look at various options of financing a BEE deal and what is deem to the most suited financing structure. The narrative phase involves semi-structured interviews that were conducted in order to ascertain the real impact that South African were faced with and how they have managed to steer clear of the turbulent waters. This also looked at how the BEE consultant views the current occurrences in the market.

The current state of Black female empowerment in the construction industry measured against broad-based Black economic empowerment scorecard

The Government of South Africa has placed a lot of emphasis on economic growth and the involvement of Black people in the mainstream of the economy. The implementation of Broad-Based Black Economic Empowerment (B-BBEE) created opportunities for direct empowerment of Black females in ownership and management. The Construction Industry is being challenged to increase the number of Black females in management and ownership levels. Due to the nature of the Industry, only a small population of females considers Construction as a career option. The Industry has also lost a significant number of skilled Engineers and is experiencing a shortage of skilled managers in Middle and Senior Management Levels. The research problem questioned the current state of empowerment for Black women in the Construction Industry as measured against the B-BBEE Scorecard. The literature review focused on the requirements of the B-BBEE scorecard and Construction Charter. The second phase focused on gender equality and the achievements of women in Construction. The research design was done by using questionnaires to the South African Federation of Civil Engineering Contractors (Safcec) members in the Eastern Cape. The research design and survey aimed to determine the status of empowerment in the Construction Industry. With reference to both the literature review and the empirical findings the state of female empowerment can be determined. Therefore iv recommendations and opportunities for further research in this regard can be identified.

Impementing broad-based black economic empowerment policy in the provisioning of houses in the Limpopo Department of Co-operative Governance, Human Settlements and Traditional Affairs

Thesis (MPA.) -- University of Limpopo, 2017 / Apartheid systematically and purposefully restricted the majority of South Africans from meaningful participation in the economy of the country. The society was characterised by entrenched gender inequality, and defined by wealth disparities and general economic exclusion of certain groups of society such as blacks, women and youth, as well as people living with disabilities. The period since 1994 has seen the South African economy undergoing restructuring. One of the major milestones in this regard was the introduction of the Broad-Based Black Economic Empowerment policy. The principal aim was to undo the legacy of dispossession and disempowerment that characterised economic development until 1994. This study was undertaken to investigate the implementation of the Broad-Based Black Economic Empowerment Policy (B-BBEE) in the Limpopo Department of Co-operative Governance, Human Settlements and Traditional Affairs. (CoGHSTA). It is also the aim of the study to investigate the processes and systems that ensure that the B-BBEE policy is fairly and equitably implemented. The study further aims at investigating the challenges in the implementation of the B-BBEE policy and suggests appropriate recommendations. The research methodology followed in this study is qualitative in nature. Semi-structured questionnaires were distributed to respondents for the collection of primary data. The main finding of the study is that, although the main aim behind the introduction of the policy is to undo the legacy of dispossession and disempowerment of the majority of South Africans, only a few politically “well connected elites” are actual beneficiaries of the empowerment deals in real terms. One of the striking findings is that officials are often not well trained on the imperatives of the policy. As such it is recommended by the study that rolling out training programmes for staff members, especially those closely working with bids in Supply Chain Management, be considered.

Sustainability of funding models used in Black Economic Empowerment transactions in the South African mining sector

A research report submitted to the Faculty of Engineering and the Built Environment, University of the Witwatersrand, Johannesburg, in partial fulfilment of the requirements for the degree of Master of Science in Engineering, 2016 / The purpose of this research is to identify and outline the sustainable funding models for BEE transactions in the South African mining industry. It is proposed that from the early 2000s to 2014 the sustainability of BEE funding models was driven by regulatory pressure. In the absence of regulatory pressure, there would be a need to develop alternative funding models. The study uses a quantitative research methodology by examining the frequency of use of various funding models, the impact of regulatory interventions and use of various funding sources on the sustainability of funding models, regression analysis and significance testing. The research results show that the percentage of third party finance in funding structures has a negative correlation with the success of BEE transactions. Vendor finance shows a positive correlation with the sustainability of transactions, more so above 60% in the funding structures. Equity finance has a positive impact on the success of transactions from as low as 20% in the funding structures. An ideal funding structure would consist of the following funding sources:  Third party: Vendor: Equity = 40%: 20%: 40%, in the case of a BEE company that has equity available and  Third party: Vendor = <40%: > 60%, where no equity is available to BEE entrepreneurs. In the absence of BEE laws third party finance will dominate funding of empowerment transactions. Funding models based on third party finance must rely more on cash flow based payments rather than dividend payments to service debt.

Marketing tactics of selected micro small businesses in the East London CBD area

This study investigates the application of conventional marketing tactics of 93 hawkers in the East London Central Business District (CBD). Its focus is on what is being practiced in this informal trading environment from a marketing point of view. To this end the primary objective was to determine the extent of the use of generally accepted principles of common (conventional) marketing in primarily black owned or managed hawker businesses in the East London CBD area. Secondary objectives centred around the degree to which new or unknown marketing tactics were implemented and to identify any influencing factors and the relevance of these to marketing. An in-depth analysis of the marketing environment of the hawker and East London region is depicted and the literature review of the relevant theory relating to the marketing of small businesses is covered and debated thoroughly. A three section questionnaire covering demographic information (Section A), the extent of the use of researcher-identified generally accepted marketing tactics (Section B), and an open ended question identifying which marketing tactics and their ranking the hawkers used in order to achieve marketing success (Section C) was implemented through interviews with 93 hawkers in the East London CBD. Although many of the individual questions results produced interesting statistics, conclusions from analysis of the composite results indicate a fair application of the marketing concept (29%) a slightly higher percentage applying the societal marketing concept (51,6%) and 38,6% of hawkers in the East London CBD applying the marketing mix. The top 3 of 7 marketing tactics identified as being used to achieve good marketing performance were customer service, stall/product presentation and the offering of a discount or discounted pricing. No significant correlations existed between the demographic statistics and the application of any particular marketing tactic. The significant influencing factors noted were the hawkers zero tolerance for competition, the lack of any long term planning, no delayed gratification or building of capital and the strong need to belong to a group or association. It was concluded that much needs to be done to investigate methods of improving the application of marketing tactics but more importantly to analyse the reason for many of their actions. Special attention is recommended to be placed on obtaining further insight and support for the observed influencing factors in order to be able to state them as fact. / Business Management / M.Comm.

Broad-based black economic empowerment as a competitive advantage in procurement in the construction industry in KwaZulu-Natal

Dissertation submitted in compliance with the requirements for the Masters Degree in Technology: Business Administration, Durban University of Technology, 2012. / The aim of this research project was to study the basic understanding the decision makers of construction companies in KwaZulu-Natal had of the Broad-based Black Economic Empowerment (BBBEE) initiative. This initiative has evolved from its origins as a form of affirmative action in the early 1990s into the broad-based initiative embodied in the Broad-based Black Economic Empowerment Act promulgated in 2003 and gazetted in 2007. Research was conducted using a questionnaire to assess the targeted population’s understanding of BBBEE. A census of the 259 construction companies affiliated with the KwaZulu-Natal Master Builders Association (NMBA) at the time of the research was used. The questionnaire was distributed primarily by email and the returns were assessed using statistical methods. The results were also tested as a cross-tabulation based on the demographics and the BBBEE rating of the respondents. The findings showed that although most of the respondents knew about the BBBEE initiative and indicated a level of understanding of this policy, certain of their perceived understandings were misguided. The way in which the Act was intended to be implemented and was intended to benefit those who were previously disadvantaged had been misread by all parties. The way in which the government has rolled out its BBBEE initiative has not been effective. This needs to be addressed by both training and partnering with those SMMEs that can most effect change to implement the Act. This study only scratched the surface of the effects the BBBEE legislation will have on small to medium-sized businesses. It has highlighted the need for further research into both the trickle-down effect of this initiative and into the availability of skilled personnel to grow the economy in the way the BBBEE Act intended.
