First, we analyze concepts related to game theory and vision of the principal authors of the areas law and economics. Next, we studied competitive strategies, market structures in equilibrium, especially oligopoly and duopoly, and exposed some questions about ethics, justice, efficiency, morality and institutions. It brings up an overview of legal aspects involving the theme of social security contributions and withholding tax and, from that, there is of course what would be more advantageous for an employer to evade the statute Brazilian light. A hypothetical case study is presented based on the Theory of Games. Finally, to show the final considerations about this work. / Este trabalho busca desenvolver um instrumental analítico que favoreça a compreensão do comportamento estratégico possível de ser adotado por contribuintes. Primeiramente, analisam-se conceitos referentes às estruturas de mercado e à teoria dos jogos. Num segundo momento, são expostas algumas questões que envolvem as instituições e o poder judiciário. Em seguida, traz-se um panorama sobre aspectos legais relacionados ao tema sonegação de contribuições previdenciárias e tributárias e, a partir disso, verifica-se logicamente o que seria mais vantajoso para um empresário sonegar a luz do diploma legal brasileiro. Um estudo hipotético de caso é apresentado com base na Teoria dos Jogos. Por fim, mostram-se as considerações finais sobre esse trabalho.
