At this point, class actions are one of the efficient instruments for resolving conflicts emerged from the postmodern society, becoming the judiciary system faster, efficient and able to support desires of society under the State of law. This study aims to analyze both the sociological and technical elements that classify the class actions as essential to the needs of the current judiciary sustem / O desafio do direito na pós-modernidade é encontrar ou adaptar instrumentos já existentes e garantir a efetividade do processo e o alargamento das vias de acesso à justiça. Neste ponto, temos as ações coletivas como um dos instrumentos aptos à solução de conflitos que emergem da sociedade pós-moderna, tornando a prestação jurisdicional célere, eficaz e suportando os anseios da sociedade submetida ao Estado de Direito. O presente trabalho tem como objetivo a análise dos elementos sociológicos e técnicos que encampam as ações coletivas como elementos essenciais às necessidades do poder judiciário atual
