The diploma thesis deals with assisted contacts of parents and children in the Czech Republic. A functioning family is essential for a child's successful development and future life. Today, many families live where stability and well-functioning family relationships are not a matter of course. Family breakdowns are becoming a more common reality that not only adults but also children have to deal with and learn to live with. In today's world we can find many forms of family. A situation where a child grows up with only one parent may in some cases be more convenient than living in a dysfunctional conflicting family that does not provide the child with enough love. Nevertheless, the child is affected by this fact. The parents' attitude in how they deal with divorce or separation represents an important factor for successful development of a child.. If the parents manage to explain the situation clearly and appropriately, given the age to the child, or whether the parents manipulate the child and draw them into their problems, the child perceives it all. This manipulation can take place in the form of so-called child programming. The point of view of the psychological needs of children, the point of toddlers' inclusion into day-care centers from the perspective of the centers themselves and the aspect of the family status in the Czech Republic and economic needs of the state. The aim of this thesis is to describe the suitability of putting toddlers into day-care centers from a theoretical point of view and to assess the convenience of putting toddlers into day-care centers in the Czech Republic.

La notion de filiation en droit comparé : droit français et droit anglais / The notion of filiation in comparative law : french law and english law

La notion de filiation renvoie au lien familial entre un parent et un enfant, lien qui ancre l'individu dans une lignée généalogique et permet de l'identifier par rapport aux membres de sa famille. Notion universelle, il a semblé pertinent d'examiner comment deux systèmes juridiques distincts, tels que ceux de droit civil et de common law, l'appréhendaient. Évoquant intuitivement un lien génétique entre le parent et l'enfant, la notion de filiation pourrait se réduire à cette dimension purement physique. Pourtant, le droit tient compte du fait qu'elle recouvre d'autres réalités, sociales et affectives, révélant ainsi une notion plus complexe. Entre la réalité génétique, devenue accessible grâce aux progrès de la science, et la volonté, employée pour fonder toutes les fictions juridiques telles que l'adoption, la procréation médicalement assistée et la gestation pour autrui, une tension est née. Le droit s'efforce de trouver un équilibre entre ces fondements grâce à la nouvelle« boussole » qu'est l'intérêt de l'enfant ainsi que grâce au cadre éprouvé de l'ordre public. L'étude comparée des droits français et anglais a permis également d'observer une dissociation croissante entre la notion et son régime, le régime pouvant être attribué indépendamment de l'existence juridique du lien. Cette dissociation en a révélé une autre, aux contours plus précis encore, entre le statut, c'est-à-dire le lien de droit initial auquel est attaché le régime, et le rôle, c'est-à-dire le comportement de fait qui se verra attribuer tout ou partie du régime de la filiation. C'est ensuite autour de l'exercice effectif de ce rôle que se réagrège une grande partie des effets de la filiation, interrogeant par conséquent la notion sur sa capacité à rendre compte des évolutions du droit de la famille. / The notion of “filiation” refers to the family relationship between a parent and a child, which place each on ein a family lineage and identify him from the members of his family. Because of its universality, it seemed appropriate to examine how two different legal systems, such as those of civil law and common law , understood it. Referring intuitively to a genetic link between parent and child, the notion of “filiation” could be, at first sight, reduced to a physical aspect. However, the law recognizes that it covers other realities like social and emotional ones. Thus, it reveals a more complex concept. In recent years, a tension appeared between genetic reality, which became available thanks to advances in science, and will, used to base alllegal fictions such as adoption, assisted reproduction and surrogacy. The law seeks to check and balancethese foundations with the child's welfare and public policy.The comparative study of French and English law also revealed a growing dissociation between the notion and its effects. Indeed, the effects can be assigned independently of the legal existence of the link. This dissociation has revealed a more precise one between the status, that is to say the initial link which isattached the effects, and the role, that is to say, the behavior which will receive all or part of the effects of filiation. Then, the effective exercise of this role can re-aggregate the effects of filiation. Thus, it is questioning the notion on its ability to account for changes in the family law .

The diploma thesis "A journey of a child from own family to a foster family - Substitute family care in the Czech republic" deals with the problematics of substitute family care focusing on foster family care. Institutional education is being taken into account as well, since it represents one of the possibilities of a child's placement out of own family. Because it is a priority and for the good of a child to grow up in a family environment, institutional education should be used only as the last possible solution. The Czech republic has been often criticised for having too high amount of children growing up in institutions and for infringing the rights arising from the Convention on the Rights of the Child. In this context foster family care and possible establishment of professional foster family care has currently been discussed in the Czech republic. Even the nowaday's system of foster family care is not spared from criticism. The solution for this system of care for children without family background inheres in establishment of professional foster family care which allows children, who cannot grow up in their bilogical families and who are not (for legal or actual reasons) suitable for adoption, to grow up in family environment. Hodnocení připravenosti dětí na zahájení povinné školní docházky pedagogickou veřejností a rodinou / Assessment of the readiness of children at compulsory school teaching public and family

The main goal of the thesis was to detect and subsequently present a comprehensive views of educational society and parents for the current issue of school preparedness and its related issues concerning the high number of school attendance delay. To obtain these views was used a method of semi-structured interviews with parents, teachers from preparatory classes and teachers from nursery and primary schools. When analysis of testimony was finished, has been used and also elected procedure confrontation between these dates, then confrontation with professional publications, articles, web discussion forums and also primary data which was find out at conference that was organized on this topic. After the research was found that the issue of school preparedness affects to other issues like: an education and qualification of nursery teachers, the quality of cooperation between school and family, problems of capacity classrooms in nursery and solving number of children and age composition of class, accountability for school readiness child etc. The results of this thesis indicate what opinions have the family and educational public on the current status of the school preparedness disadvantages of children and also parts of school preparedness, in which today's children mainly excel.
