La contribución de los escándalos políticos mediáticos al ejercicio de la accountability de actos de corrupción. El caso del escándalo de los “CNM Audios”

Los escándalos tienen la capacidad de modificar la composición del campo político, excluyendo del mismo a aquellos actores que no respetaron las reglas del juego político. En tal sentido, se puede afirmar que los escándalos tendrían la capacidad de activar los mecanismos de accountability, a través de cuyo ejercicio se busca garantizar que los actores encargados de administrar el poder lo ejerzan en respeto de los intereses de los ciudadanos, otorgando herramientas para sancionar a aquellos que transgreden los principios del interés público sobre el cual descansa la legitimidad de su autoridad. La presente tesis analiza la relación entre los escándalos políticos mediáticos y la activación de la accountability, especialmente cuando los mecanismos tradicionales de la misma registran serias debilidades o se resisten a ejercer su función, son laxas ante el abuso de poder o el mal ejercicio del mismo. El análisis, por tanto, se centrará en la acctivación de mecanismos sociales de accountability -también conocido como accountability social-, es decir, de aquellas formas de control vertical no electoral del estado, que se activan a través de la intervención de grupos sociales, colectivos, ONGs y periodistas. El caso estudiado es el de los llamados CNM Audios, el escándalo mediático provocado por la revelación mediática, en julio y agosto de 2018, de más de 200 audios que registraron conversaciones entre jueces supremos y superiores, fiscales, consejeros del CNM, empresarios, congresistas, abogados, entre otros, en las que se negociaba sentencias, se fijaban sobornos, se acordaba reducción de penas y se coordinaba acciones para ratificar magistrados y conseguir que solo 'gente de confianza' ocupen los principales cargos en diversas instancias del sistema judicial, principalmente, en el Consejo Nacional de la Magistratura. / Scandals have the capability of modifying the composition of the political field, excluding those actors who did not respect the rules of the political game. In this sense, it can be stated that scandals would have the ability to activate accountability mechanisms whose exercise guarantee that the actors in charge of administering power exercise it with due regard to the interests of the citizens and granting the tools that would sanction those who violate the principles of public interest upon which the legitimacy of their authority rests. This thesis analyzes the relationship between media coverage of political scandals and the activation of accountability, especially when traditional mechanisms register serious weaknesses or register some resistance in exercising their function, showing 'tolerance' to concrete expressions of power abuse. The analysis will therefore focus on the activation of social accountability mechanisms -also known as social accountability-, which are all forms of vertical non-electoral control of the state that are activated through the intervention of social groups, organizations, NGOs and journalists. The case studied is that of the so-called CNM Audios, the media scandal caused by the media disclosure, in July and August of 2018, of more than 200 audios that recorded conversations between Peruvian supreme and superior judges, prosecutors, counselors of the National Council of the Magistracy (CNM) (Peru's judicial appointment body), businessmen, congressmen, lawyers, among others, in which sentences were negotiated, bribes were fixed, reduction of penalties were agreed on and actions were coordinated to ratify judges and ensure that only 'trusted people' occupied the main positions in various instances of the judicial system, mainly, in the CNM.
