A justiça bate à porta: o papel do oficial de justiça na efetividade da prestação jurisdicional

Este trabalho identifica a importância da função exercida pelo Oficial de Justiça, que diuturnamente bate à porta das pessoas para, além de cumprir seus deveres institucionais, possibilitar aos jurisdicionados uma prestação jurisdicional efetiva. A benvinda tecnologia processual que visa contemplar a tão desejada celeridade processual, inovou principalmente a possibilidade de acompanhar todos os passos do processo em tempo real, exigiu que a prestação jurisdicional seja mais rápida, mas não pôde substituir o componente humano, e nessa linha, o papel do OJ, como elo jurisdicionado e Judiciário, se faz bastante presente. Com base nas funções exercidas há séculos, discutiu-se sua presença dentro da maioria dos órgãos que compõe o Judiciário até hoje, diante da era eletrônica e o novo Código de Processo Civil. Identificou-se seu perfil dentro outras realidades, como a possível extinção do cargo, sua relevada atuação nas diversas áreas do Direito e sua e inclusão no novo paradigma social, proposto pela autocomposição no novo Código de Processo Civil. Buscou-se evidenciar o elo propiciado pelo oficial de justiça entre o jurisdicionado e o Judiciário como meio de concretizar a justiça, que vai além do processo eletrônico, bem como identificar o atual perfil deste servidor, conhecendo suas atribuições e regulamentação ao qual está sujeito. Utilizou-se as pesquisas teóricas e empírica. Demonstrou-se a função do OJ como importante componente humano e partícipe da entrega da boa prestação jurisdicional, alicerçada pelos direitos fundamentais positivados na Constituição Federal, vislumbrado pela nova atribuição de mediador de litígios no cenário do novo CPC, prestes a entrar em vigor. / This work identifies the importance of the function performed by the Bailiff, who continually knocks on people’s doors to not only fulfill their institutional duties, but also enable an effective jurisdictional adjudication. The welcome procedural technology, which aims to encompass the much-desired speedy trial, innovated particularly the possibility to follow every step of the process in real time, by demanding the adjudication to be faster, but could not replace the human component; therefore, the role of the Bailiff, as a link between the claimants and the Judiciary, is still present. Based on the functions performed over the centuries, we discussed their presence within the majority of the organs that make up the judiciary until today, considering the electronic age and the new Civil Procedure Code. We identified their profile within other realities, such as the possible extinction of the office, their relevant acting in several areas of law and their inclusion in the new social paradigm, proposed by its self-composition in the new Civil Procedure Code. We sought to highlight the link afforded by the Bailiff between the claimants and the judiciary as a means to achieve justice, which goes beyond the electronic process, as well as to identify the current profile of this server, by knowing their duties and the regulations to which they are subject. We used the theoretical and empirical research. We pointed the function of the Bailiff as an important human component and participant in the delivery of good adjudication, based on the fundamental rights positivized in the Constitution, glimpsed by the new attribution of a dispute mediator in the new scenario of the CPC, about to come into effect.

Literatura en entornos interculturales: Análisis del papel de la literatura en el contexto universitario sueco. / Literature in intercultural environments: An analysis of the role of literature in the Swedish university context.

La presente investigación tiene como objetivo principal analizar la enseñanza y el aprendizaje del análisis de textos literarios en ambientes interculturales dentro del sistema universitario sueco. Esta investigación abarca el análisis literario en su sentido heurístico, la forma en la que este se presenta en un grupo intercultural de estudiantes, así como el rol que desempeña el docente en la promoción de una lectura holística y analítica enmarcada en este nivel de aprendizaje. Este estudio tiene dos enfoques privilegiados: determinar la manera en que estudiantes de entornos de procedencia nativa y no nativa perciben la lectura y el análisis del mundo literario de la esfera latinoamericana; y resaltar la capacidad de los profesores de construir puentes entre el conocimiento cultural previo de los estudiantes, en entornos culturalmente heterogéneos, para ayudarlos a desarrollar una lectura más estética. Para ilustrar este estudio contrastivo, se realizaron observaciones de clase, así como cuestionarios a estudiantes y profesores con el fin de apoyar las hipótesis propuestas en la investigación. Igualmente, se resaltó el hecho de que los estudiantes de procedencia hispana se encuentran más dispuestos a desarrollar, en un nivel superior, el análisis literario perteneciente a su bagaje cultural; mientras que aquellos provenientes de ambientes no nativos no poseen esta capacidad, en cierta medida, debido a diferencias socioculturales. De la misma manera, con el objetivo de desarrollar la metacultura para que el análisis literario sea más accesible a los estudiantes, se debe ir más allá de los límites culturales resaltando el componente humano, como el vínculo al entendimiento de la experiencia universal encontrada en el texto, entendida como el elemento humano que trasciende las fronteras culturales. Un análisis detallado de ambos componentes, el profesor y el estudiante, concluye que la herencia cultural del estudiante juega un papel integral en su entendimiento holístico del texto. En segundo lugar, se observa que estudiantes y profesores coinciden en que el componente humano del texto es el que finalmente juega un papel vital en el proceso de lectura y se constituye como parte integral en la relación que el estudiante desarrolla con el texto. Finalmente, se discute sobre el papel del docente como una guía para este proceso y su responsabilidad en mantener el fundamental rol de la literatura como arte lingüístico y herramienta para el enriquecimiento de la clase. / The present investigation aims to analyse the teaching and analysis of literary texts in intercultural environments in the Swedish University system. In order to carry out this investigation, literary analysis will be considered in its heuristic sense, the ways it is realised by an intercultural group of students, as well as the role that the teacher holds in promoting a holistic reading and analysis within his level of studies. This study has the dual intention of firstly determining how students from native, non-native and heritage backgrounds perceive reading and analysis of the literary world in the Hispano-American sphere. Secondly, the aim is to highlight how teachers are able to build bridges between the student’s existing cultural knowledge in culturally heterogeneous environments to help them carry out more aesthetic readings. To illustrate this study, reference is made to the use of class-based observations, and a student and teacher questionnaire in order to support our proposed hypotheses. The aim is to  highlight that students coming from a native Hispanic background are more able to develop a distinct level of literary analysis owing to their innatecultural heritage whereas non-natives lack this background to a certain point as a result of sociocultural differences. Furthermore, one determines that when analysing literature, in order to make the metaculture more accessible to students, one has to go beyond the cultural limits by highlighting the human component, as the link to understanding that the universal experience found in the text is the human element that transcends the cultural divides.  A detailed analysis provided for both the student and teacher components concludes that the student’s cultural heritage plays an integral part in their holistic understanding of a text, but their personal motivation is a factor that impacts on their literary knowledge. Secondly, we see that both teachers and students concur that the human component of the text ultimately is a vital stage in the reading and interpretation process. Finally, the role of the teacher as a guide in this process is discussed. He is also seen as being responsable for encouraging the pivotal role of literature as a linguistic art and tool for enrichment in the classroom.
