Promoción de viviendas para uso propio : obligaciones y responsabilidades en derecho de la edificación

Este trabajo estudia las distintas modalidades de promoción de viviendas para uso propio (la autopromoción individual, la autopromoción colectiva en régimen de comunidad de propietarios y en régimen de cooperativas de viviendas) y sus características diferenciales respecto de la promoción inmobiliaria desarrollada por sociedades mercantiles. La tesis analiza las obligaciones y responsabilidades que el ordenamiento jurídico privado impone a todo promotor inmobiliario, especialmente las responsabilidades derivadas de vicios y defectos constructivos, examina su fundamento y cuestiona su aplicación a aquellos sujetos que actúan ajenos al ejercicio de una actividad empresarial. La tesis también estudia la figura del gestor de comunidades de propietarios y de cooperativas de viviendas, así como el alcance de su responsabilidad cuando interviene en fraude de ley. / This dissertation aims at discussing the different methods of housing development for personal uses (individual housing development, collective housing development in coownership or through cooperative housing) and at highlighting their distinctive characteristics in respect to housing development by real estate or construction companies. The thesis analyzes the legal duties and liabilities that Spanish private law vests upon all real estate developers, specifically liabilities arising from construction defects, as well as their legal basis. Moreover, the dissertation questions the application of this legal regime to individuals acting for purposes not related to his or her trade, business or profession. Finally, problems related with professionals working as independent representatives of collective housing developers and their liability when acting in fraus legis are examined
