The development of the nature preserves system in Indiana : giving life to the land ethic

The movement to conserve natural resources in the United States began as a response to the perceived inefficiency which governed resource allocation. The subsequent environmental movement served to expand the definition of conservation to include not only the efficient use of resources, but also the preservation of land in its natural state. In Indiana, this supposed deficiency in conservation led some environmentalists to establish the Indiana Nature Preserves System which locates remnants of the Indiana wilderness and protects them from development. The Indiana Nature Preserves System is symbolic of the Land Ethic proposed by the early ecologist Aldo Leopold, who believed that man was but one component of the "land community." To alter all natural areas, Leopold and Indiana preservationists argued, was both an assault on ecological stability and on the right of nature to exist for its own sake. / Department of History

Creating a new declaration of rights : a critical reconstruction of earth jurisprudence's global legislative framework

This thesis aims to critique the Universal Declaration of the Rights of Mother Earth and its underlying moral justification in order to provide a stronger and improved version of both. In Chapter 1 I explore what sort of moral justification is necessary to establish the Universal Declaration on firm grounds and explore its relation to environmental ethics and rights discourse. I argue that a non-anthropocentric perspective is necessary to justify the Universal Declaration’s rights. In Chapter 2 I explore the underlying justification of the Universal Declaration as discovered in the works of Cormac Cullinan and Father Thomas Berry. I argue that their ethical framework is indeterminate, has many ambiguities and uncertainties, and, among other problems, it does not provide a clear action-guiding framework. In Chapter 3 I develop an alternative justification for the Universal Declaration. I argue against many predominant moral theories, that in light of our best scientific and moral understanding we should expand the realm of moral concern to include all living beings, a moral theory I call Life’s Imperative. In Chapter 4 I illustrate that Life’s Imperative is a much stronger, more coherent justification for the Universal Declaration, one that coheres with both our best understanding of the natural world and our relation to it, and to an environmental ethic reflective of that relationship. Unfortunately many of the weaknesses in the current implicit justification of the Universal Declaration have also led to it enshrining rights that are themselves problematic. In order to address these issues, I revise its rights to accord with the stronger justification that I established in Chapter 3. The end result of doing so is a revised version of the Universal Declaration

Ray P. Holland, Editor and Conservationist

The problem involved in this study was to determine the success or failure of the use of the editorial in achieving a goal, specifically, editorials by Ray P. Holland in favor of the Migratory Bird Conservation Act of 1929 and the Migratory Bird Hunting Stamp Act of 1934. Editorials from the Bulletin of the American Game Protective Association and Field and Stream were classified into categories to show an editorial position over a selected time period. Material from the permanent collection of the Holland library at Wesleyan University and family information was used to record a biography of Holland's achievements. The study shows that Holland's contributions in journalism will stand as a benchmark to ensuing generations of journalists who seek to realize their goals through the proper use of the editorial.

Les effets auto-consistantes sont omniprésents dans les plasmas de fusion. Ils sont dus au fait que les équations de Maxwell qui décrivent l’évolution des champs électromagnétiques contiennent la densité de charge et de courant des particules.D’autre côté à son tour les trajectoires des particules sont influencés par les champs à travers les équations de mouvement ( où l’équation de Vlasov). Le résultat decette interaction auto-consistente se résume dans un effet cumulatif qui peut causer le déconfinement de plasma à l’intérieur d’une machine de fusion. Ce travail de thèse traite les problèmes liés à l’amélioration de confinement de plasma de fusion dans le cadre des approches hamiltonienne et lagrangien par le contrôle de transport turbulent et la création des barrières de transport. Les fluctuations auto-consistantes de champs électromagnétiques et de densités des particules sont à l’origine de l’apparition des instabilités de plasma qui sont à son tour liés aux phénomènes de transport. Dans la perspective de comprendre les mécanismes de la turbulence sousjacente,on considère ici l’application des méthodes hamiltoniennes pour des plasmasnon-collisionnelles / This thesis deals with dynamicla investigation of magnetically confined fusion plasmas by using Lagrangian and Hamilton formalisms. It consists of three parts. The first part is devoted to the investigation of barrier formation for the EXB drift model by means of the Hamiltonian control method. The strong magnetic field approach is relevant for magnetically confined fusion plasmas ; this is why at the first approximation one can consider the dynamics of particles driven by constant and uniform magnetic field. In this case only the electrostatic turbulence is taken into account. During this study the expressions for the control term (quadratic in perturbation amplitude) additive to the electrostatic potential, has been obtained. The effeciency of such a control for stopping turbulent diffusion has been shown analytically abd numerically. The second and the third parts of this thesis are devoted to study of self consistent phenomena in magnetized plasmas through the Maxwell-Vlasov model. In particular, the second part of this thesis treats the problem of the monumentum transport by derivation of its conservation law. the Euler-Poincare variational principle (with constrained variations) as well as Noether's theorem is apllied here. this derivation is realized in two cases : first, in electromagnetic turbulence case for the full Maxwell-Vlasov system, and then in electrostatic turbulence case for the gyrokinetic Maxwell-Vlasov system. Then the intrinsic mechanisms reponsible for the intrinsic plama rotation, that can give an important in plasma stabilization, are identified. The last part of this thesis deals with dynamicla reduction for the Maxwell-Vlaslov model. More particularly; the intrisic formulation for the guiding center model is derived. Here the term 'intrinsis" means that no fixed frame was used during its construction. Due to that not any problem related to the gyrogauge dependence of dynamics appears. The study of orbits of trapped particles is considered as one of the possible for illustration of the first step of such a dynamical reduction.

South Africa’s response in fulfilling her obligations to meet the legal measures of wetland conservation and wise use

Thesis (MTech (Environmental Management))--Cape Peninsula University of Technology, 2018. / South Africa is a signatory to the Convention on Wetlands of International Importance especially as Waterfowl Habitat of 1971 (referred to as the Ramsar Convention), which is an international convention making provision for protection and wise use of wetlands. Article 3 of the Ramsar Convention requires signatories to formulate and implement their planning to promote wise use of wetlands within their jurisdiction. “Wise use of wetlands” is defined as “the maintenance of their ecological character, achieved through the implementation of ecosystem approaches, within the context of sustainable development” (Birnie & Boyle, 2009: 674). The concept of wise use has been interpreted to mean sustainable development (de Klemm & Shine, 1999: 47; Birnie & Boyle, 2009: 49; Kiss & Shelton, 2007: 93; Birnie & Boyle, 2009: 674; Sands, 2003: 604), as it pertains to wetlands. Having said this, the National Environmental Management Act 107 of 1998 (NEMA) sets out principles of sustainable development that every organ of state must apply in the execution of their duties. Due to the wise use-sustainable development link, two NEMA principles have been considered to form the basis of this study, i.e. sections 2(4)(l) and 2(4)(r). The first principle places an obligation upon the state to ensure that there is intergovernmental coordination and harmonisation of policies, legislation and action relating to the environment (read to include a wetland); and the second principle is to ensure that specific attention in the management and planning are had to wetlands. Ironically, factors that are identified as hindering wise use include, but are not limited to: conflicting and incomplete sectoral law, absence of monitoring procedures, the absence of legal measures for environmental management of water quantity and quality. Therefore, an analysis will be undertaken to determine the extent to which South Africa’s legislative framework regulating wetland conservation is fulfilling the requirements for the promotion of wise use, through these two principles. Focus was had to environmental and related legislation, policies and regulations that promote and/or constrain wetland conservation and wise use. This study identifies the flaws within the law; and proposes streamlining and, where apposite, amendments to the existing legislative framework regulating wetlands in order for South Africa to fulfil her obligations.

On étudie dans ce travail des systèmes de lois de conservation hyperboliques. La première partie étudie le temps d'existence des solutions régulières et régulières par morceaux de la dynamique des fluides compressibles. Après avoir présenté l'état de l'art en matière de solutions régulières, on montre une extension d'un théorème de Grassin à des gaz de Van der Waals. On étudie ensuite les solutions ondes de chocs : on poursuit l'approche de T. T. Li pour estimer leur temps d'existence dans le cas isentropique à symétrie sphérique, et l'approche de Whitham afin d'obtenir une équation approchée vérifiée par la surface de discontinuité. Dans une deuxième partie, motivée par la modélisation d'un rond-point en trafic routier, on étudie une extension multi-classe du modèle macroscopique de Lighthill-Whitham-Richards sur une route infinie avec des jonctions. On différencie les véhicules selon leur origine et leur destination et on introduit des conditions aux bords adaptées au niveau des jonctions. On obtient existence et unicité d'une solution au problème de Riemann pour ce modèle. Des simulations numériques attestent que les solutions obtenues existent en temps long. On aborde enfin le problème de Cauchy par la méthode de front tracking. La dernière partie concerne les lois de conservation scalaires. La première question abordée est le contrôle de la variation totale de la solution et la stabilité des solutions faibles entropiques par rapport au flux et à la source. Ce résultat nous permet d'étudier des équations avec flux non-local. Une fois établi leur caractère bien posé, on montre la Gâteaux-différentiabilité du semi-groupe obtenu par rapport aux conditions initiales. / In this work, we study hyperbolic systems of balance laws. The first part is devoted to compressible fluid dynamics, and particularly to the lifespan of smooth or piecewise smooth solutions. After presenting the state of art, we show an extension to more general gases of a theorem by Grassin.We also study shock waves solutions: first, we extend T. T. Li's approach to estimate the time of existence in the isentropic spherical case; second, we develop Whitham's ideas to obtain an approximated equation satisfied by the discontinuity surface. In the second part, we set up a new model for a roundabout. This leads us to study a multi-class extension of the macroscopic Lighthill-Whitham-Richards' model. We study the traffic on an infinite road, with some points of junction. We distinguish vehicles according to their origin and destination and add some boundary conditions at the junctions. We obtain existence and uniqueness of a weak entropy solution for the Riemann problem. As a complement, we provide numerical simulations that exhibit solutions with a long time of existence. Finally, the Cauchy problem is tackled by the front tracking method. In the last part, we are interested in scalar hyperbolic balance laws. The first question addressed is the control of the total variation and the stability of entropy solutions with respect to flow and source. With this result, we can study equations with non-local flow, which do not fit into the framework of classical theorems. We show here that these kinds of equations are well posed and we show the Gâteaux-differentiability with respect to initial conditions, which is important to characterize maxima or minima of a given cost functional.

Local people's perceptions of marine protected areas : a case study of Ponta do Ouro, Mozambique.

Marine protected areas (MPAs) cannot be managed outside the context of human societies that are dependent on their associated ecosystems and resources. This means that local people’s perceptions need to be considered in the establishment of MPAs as well as their subsequent management, planning and decision making processes. Accordingly, this study investigated respondents’ perceptions of the Ponta do Ouro – Kosi Bay MPA. The MPA is part of the now proclaimed Lubombo Trans-frontier Conservation Area (TFCA). An interviewer - administered questionnaire was used to obtain primary data from 35 respondents, all resident in the study area and who are involved in various activities based on the coastal area and its marine resources. The focus of the study was on awareness regarding the establishment, impacts of the MPA, the setting of priorities for the MPA and lastly, respondents’ roles and responsibilities The findings from the study reveal low levels of awareness of the establishment of the MPA among respondents, although there was acknowledgement of its potential contribution to biodiversity conservation. Various types of impacts of the establishment of the MPA were noted. The establishment of the MPA was perceived to negatively impact on the access to, and use of, marine resources. It was also felt that the MPA would impact on the exercise of traditional authority. Concerning the setting of future priorities for the MPA, socio-economic considerations, particularly job creation rated highest. Biodiversity conservation ranked highest in terms of factors that should shape the current priorities of the MPA. Overall, tourism and related job creation and biodiversity conservation were identified as the main opportunities associated with the establishment of the MPA. Controlling access to the area, curbing inappropriate resource use, controlling development and ensuring that local people benefit were highlighted as major opportunity benefits. Constraints were mainly considered in relation to the exercise of traditional leadership, access to the area and restrictions in selling of harvested marine resources. Regarding how to collaborate in the MPA, various skills among the respondents were mentioned, with respect to the following areas: enforcement (control, patrols and security) and community relations and awareness (including communication and the translation of documents). Lastly, while the respondents displayed both supportive and unsupportive attitudes as results of perceptions of the intended MPA, in an overall sense, the MPA was considered as a positive development. This was in spite of the perceived weak communications that exist at present between the authorities and local people. Enhanced, communication between authorities in charge of the MPA and local people could help to provide a more positive sentiment towards the MPA. This is particularly true of the local people who, if they understood the rationale for the MPA more fully and how it would impact on their use of the resources of the MPA, would be more likely to support its establishment and existence. / Thesis (M.Env.Dev.)-University of KwaZulu-Natal, Pietermaritzburg, 2008.
