Orientador: Kelly Cristina Canela / Banca: Luciana Lopes Canavez / Banca: Fabio Pallaretti Calcini / Resumo: O presente trabalho teve por objetivo verificar o tratamento dado pela jurisprudência dos Tribunais Regionais Federais às ações revisionais de contratos habitacionais inseridas no Programa Minha Casa, Minha Vida, para tanto foram selecionados acórdãos utilizando os principais temas desse trabalho - moradia, Programa Minha Casa, Minha Vida, revisão - como palavras-chaves. Investigou se os fundamentos das decisões judiciais dos referidos tribunais apreciaram o direito fundamental social à moradia envolvido e se as interpretações adotadas utilizaram como parâmetro o princípio da dignidade humana e os princípios de direito contratual, aplicando esforços para conservar ao máximo o contrato sob análise para efetivação do direito à moradia e realização da política pública. O estudo se iniciou com o instituto da revisão contratual, seus parâmetros e requisitos de aplicação, passou pelas novas diretrizes do direito contratual, em especial o princípio da conservação dos contratos. Na sequência, adentrou-se aos direitos sociais e sua importância para a garantia de uma vida digna. Especial atenção foi dada ao direito à moradia, seu caráter de mínimo indispensável e parte de um patrimônio mínimo. As políticas públicas habitacionais implementadas pelo Estado brasileiro e seu caráter iminente voltado a aquisição da propriedade de imóvel, também foram objeto de estudo. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The present paper has the objective to verify the treatment given by the jurisprudence of the Federal Regional Courts to the revisional actions in housing contracts of My House, My Life Program, for that were selected decisions based on the main themes of this work - housing, My House, My Life Program, revision - as key-words. Investigates if the arguments of the judicial decisions of that courts appreciate the fundamental housing right involved and if the interpretation adopted used as parameter the right to dignity and the contractual right principles, applying efforts to conserve as much as possible the contract under analysis to implement housing right and public policy. The research starts studying the revisional contracts institute, its parameters and application requirements, passing thru the new directives of contractual law, in particular the contracts maintenance principle. In sequence, investigates the social rights and its importance to guarantee a dignified life. Particular attention is given to the housing right and its caracter as indispensable and minimum property. The housing public policy implemented by Brazilian government has its characters directed to property acquisition. Then aware of the My Home, My Life requirements and limitations court judgments are study under its social approaches, checking which were the substrates used to solve the demand. As result was verified that in spite of not having a uniform positioning in favour of the right to housing, it was possible to find decisions focused on the essence of the fundamentality and indispensability of this right. / Mestre
