La jornada y el horario de trabajo se configuran, de un lado, como la potestad del empleador para regular el tiempo que el trabajador está a su disposición y, por otro, como derechos básicos y elementales del trabajador para que pueda conciliar el trabajo con su vida familiar. Es así que en el presente artículo, el autor realiza una explicación amplia de la definición de jornada y horario de trabajo, derechos reconocidos en los convenios de la Organización Internacional del Trabajo y en nuestra normativa constitucional y legal, abordando, también, las exclusiones a las mismas, su determinación, las jornadas atípicas, el trabajo en sobretiempo y el trabajo nocturno. Sin duda, un artículo de lectura obligatoria para todo aquel interesado en el Derecho Laboral. Work days and working hours are established, on one hand, by the authority of employers to establish the hours that workers are at their disposal and, on the other, by the basic and elemental rights of workers to enable them to harmonize their work with their family lives. In this article, the author provides extended definitions of the work day and working hours as rights that are recognized in the conventions of the International Labor Organization and in Peruvian constitutional and labor law. The discussion also includes: omissions that exist in these norms; the manner in which these norms were decided upon; and issues such as atypical work days, overtime, and night working hours. The analysis provided is obligatory reading for everyone interested in Labor Law.
