Por uma teoria da norma administrativa sancionat?ria : o regime jur?dico-administrativo brasileiro e a incid?ncia da teoria das restri??es aos direitos fundamentais

Demonstrating that the legal restriction of fundamental rights is an important corner for sanctioning administrative law-in particular to be seen what would be the norm and typical administrative rule which could eventually be considered atypical. In the first chapter in an analytical part, it is a reconstruction of the historical formation of the French administrative law, pointing out the major historical moments that passed by the discipline that the legal system, naming, including the major doctrinal theses erected there. By then, a succinct analysis of the history and training of administrative law systems in the German and Italian, aiming for an equal, ideas for the formation of administrative law in Brazil. Settled such premises, administrative law was revisited in the Brazilian system, from its formation to the present, pointing out the important elements of their training. In the second chapter, established the legal and administrative, on the French model, also in this same line of analysis, develops an approach to demonstrate on pillars which formed such a regime, emphasizing the principles of separation of judicial and administrative authority and the principle of legality. By then went on to discuss the legal and administrative Brazil, emphasizing at the outset, the necessary deconstruction of the argument that the principles of supremacy of public interest and the unavailability of public interest over the private sector constituted the basis of our legal and administrative. The historic position in this direction, as shown, is not retaining legal and administrative arrangements in Brazil. Thus, the public interest, historically identified as being particularly distinctive element of the scheme, grants in favor of the principle of human dignity, even so we could recognize, in the second chapter, the applicability of the Theory of Constraint fundamental rights to our penalties. Demonstrando que o regime jur?dico das restri??es aos direitos fundamentais constitui importante v?rtice para o direito administrativo sancionador, nomeadamente, para que seja verificada qual seria a norma administrativa t?pica e qual norma eventualmente poderia ser considerada at?pica. No primeiro cap?tulo, em uma parte anal?tica, faz-se uma reconstru??o da forma??o hist?rica do direito administrativo franc?s, apontando os principais momentos hist?ricos por que passou a disciplina naquele sistema jur?dico, nomeando, inclusive, as principais teses doutrin?rias l? erigidas. Ao depois, uma suscinta an?lise sobre a hist?ria e forma??o do direito administrativo nos sistemas alem?o e italiano, apontando, por igual, as id?ias para a forma??o do direito administrativo no Brasil. Assentadas tais premissas, foi revisitado o direito administrativo no sistema brasileiro, desde sua forma??o at? o presente momento, apontando os elementos importantes de sua forma??o. No segundo cap?tulo, estabelecido o regime jur?dico-administrativo, no modelo franc?s, tamb?m nesta mesma linha anal?tica, desenvolve-se uma abordagem para demonstrar sobre quais pilares formou-se tal regime, dando ?nfase aos princ?pios da separa??o entre autoridade administrativa e autoridade judici?ria e ao princ?pio da legalidade. Ao depois, passou-se a discorrer sobre o regime jur?dico-administrativo brasileiro, dando ?nfase, de in?cio, a necess?ria desconstru??o da tese de que os princ?pios da supremacia do interesse p?blico e da indisponibilidade do interesse p?blico sobre o privado constitu?ram a base de nosso regime jur?dico-administrativo. A posi??o hist?rica nesse sentido, conforme demonstramos, n?o encontra arrimo no regime jur?dico-administrativo brasileiro. Assim, o interesse p?blico, historicamente apontado como sendo elemento distintivo desse regime especial, cede em favor do princ?pio da dignidade humana, inclusive para que fosse poss?vel reconhecer, ainda no segundo cap?tulo, a possibilidade de aplica??o da Teoria da Restri??o aos direitos fundamentais ao nosso regime sancionat?rio. Ato cont?nuo, no terceiro cap?tulo, foram enfrentados os temas do princ?pio da legalidade administrativa, da legalidade no direito penal, discorreu-se ainda sobre a norma administrativa e suas principais caracter?sticas. A partir da? foram demonstrados diversos modelos relacionais da norma de direito administrativo, resguardando o tema de fundo em sua linha de conduta inquebr?vel. Por fim, chegou-se a an?lise da norma mais efetivamente incompat?vel com a esfera administrativa brasileira, qual seja a norma de improbidade administrativa. Diversos motivos incompatibilizam a improbidade ? esfera administrativa, a come?ar pelo conte?do da pr?pria LIA, em pelo menos tr?s dispositivos. Demonstrada a carga formal e substancial que lastreia a inconstitucionalidade da LIA, demonstramos igualmente, o liame jur?dico a que liga o regime jur?dico-administrativo ? teoria das restri??es aos direitos, tendo toda a an?lise por escopo desvelar mecanismos de garantia para o direito administrativo sancionat?rio
