We tried to determine the limits imposed to the governments on their industrial policy by the norms in the Agreement on Subsidies and Countervailing Measures (ASCM) of the WTO and the by the decisions of the Panels and the Appellate Body of that Organization. After general remarks about the WTO, the analyses of the ASCM and the assessment of the relevance of the jurisprudence in the judgment of futures cases, decisions of the Dispute Settlement Body were examined in order to understand the limitations imposed to the States on the decisions concerning industrial policy and how the States can pursue industrial without disrespecting the rules of the WTO. / O presente estudo objetivou examinar de uma forma geral as normas especificas sobre subsídios na OMC - Organização Mundial do Comércio - bem como fazer um levantamento e uma análise das decisões desse órgão sobre os casos de subsídios, buscando demonstrar qual conduta dos Estados é aceitável, tanto pela legislação em si como pela interpretação da mesma. Buscou-se determinar os limites impostos aos governos em sua política industrial pelas normas contidas no Acordo de Subsídios e Medidas Compensatórias (ASMC) da OMG, bem coma pelas decisões dos painéis e do Órgão de Apelação da Organização Mundial do Comércio. Foi dada ênfase - após uma visão geral sabre a Organização Mundial do Comércio - à análise do Acordo de Subsídios e Medidas Compensatórias em suas peculiaridades e a verificação da relevância da jurisprudência da OMC em casos futuros sobre as decisões oriundas do Órgão de Solução de Controvérsias, na busca da compreensão de quais são as limitações impostas aos Estados em sua política industrial e na forma coma os Estados podem utilizar políticas industriais sem infringir as normas da OMC.
